SALARY ORDINANCE AMENDMENT
(AS AMENDED FROM ORIGINAL PROPOSED ORDINANCE NO. D-1195-96)
AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL,
INDIANA, AMENDING ORDINANCE D-1159
TO ESTABHSH
THE SALARIES OF THE EMPLOYEES WITHIN
THE DEPARTMENT OF LAW
WHEREAS, Section 2-3 of The Cannel City Code establishes pursuant to LC. 36-4-9, a
Department of Law with the head of such, (the ,'City Attorney") to be appointed by the Mayor
and to administer the powers and to perform those duties set forth in LC. 36-4-9-12; and
WHEREAS, The Mayor has elected to employ, rather than to contract with, the person to
serve as the City Attorney; and
WHEREAS, Ordinance No. D-1159 did not include salaries for positions within the
Department of Law; and
WHEREAS, L C. 36-1-4-15 authorizes a municipality to fix compensation of employees.
NOW, THEREFORE, BE IT ORDAIN D BY THE COMMON COUNCIL OF THE
CITY OF CARMEL, INDIANA, AS FOLLOWS:
Section I. Ordinance D-1159 is hereby mended to include the Department of Law and to set the
salaries in the Department of Law.
Department and Position

Department of Law
Up to a maximum Salary of:
City Attorney
$2,307.69 for up to thirty (30) hours per week;
Administrative Assistant
$1,119.87.
Section H. Annual salaries for the employees listed above and not exempt under the Fair Labor
Standards Act of 1938, as Amended, (29 U.S.C. 201, et seq.), (the "FLSA"), are for up to thirty-
seven and one half (37 1/2) hours worked per work week. Hours worked in excess of forty (40)
hours worked per week shall be compensated at one and one half (11/2) times the employee's
regular hourly rate as defined in the FLSA.
Section llI. Notwithstanding anything to the contrary comained in the Cannel City Code, the
City Attorney shall be considered a full time permanent employee for purposes of the Employee
Fringe Benefit Program set forth in Section 2-37 of the Carrnel City Code, as such is amended
~'om time to time.
Section IV. This Ordinance shall have no effect on any provision in Ordinance D-1159 which is
not specifically amended hereby.
Section V. This Ordinance shall be in full force and effect as of January 1, 1996, once it has
received passage, approval and signing by the Mayor.
PASSED AND ADOPTED by the Common Council of the City of Carmet, Indiana, this
