HomeMy WebLinkAboutD-1195-96 Est. Dept. of AdministrationOrdinance D- 1195-96 SALARY ORDINANCE AMENDMENT AND CREATION OF DEPARTMENT OF ADMINISTRATION (AS AMENDED FROM ORIGINAL PROPOSED ORDINANCE NO. D-1195-96) AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, AMENDING ORDINANCE D-1159 BY THE CREATION OF THE DEPARTMENT OF ADMINISTRATION TOGETHER WITH THE ESTABLISHMENT OF THE SALARIES OF THE EMPLOYEES WITHIN SUCH DEPARTMENT WHEREAS, L C. 36-4-9-4 provides that the Common Council shall, by ordinance passed upon the recommendation of the Mayor, establish the executive departments that it considers necessary to efficiently perform the administrative functions required to fulfill the needs of the citizens of the City of Carmel; and WHEREAS, The Mayor recommends to the Common Council the establishment of the Department of Administration so that the needs of the citizens of the City of Carreel are met in the most efficient, cost effective manner; and WHEREAS, Ordinance D-1159 did not establish the 1996 salaries for the employees within the Department of Administration; and WHEREAS, L C. 36-1-4-15 authorizes a municipality to fix compensation of employees. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, AS FOLLOWS: Section I. The Department of Administration is hereby established. Section II. Ordinance D-1159 is hereby mended to include the Department of Administration and to set the salaries in the Department of Administration. Department and Position BW Department of Administration Up to a maximum salary of: Director of Human Resources Division $1,384.62; and Administrative Assistant $1,065.84; Section Ill. Annual salaries for the employees listed above and not exempt under the Fair Labor Standards Act of 1938, as Amended, (29 U.S.C. 201, et seq.), (the "FLSA"), are for up to thirty- seven and one half (37 1/2) hours worked per work week. Hours worked in excess of forty (40) hours worked per week shall be compensated at one and one half(11/2) times the employee's regular hourly rate as defined in the FLSA. Section V. This Ordinance shall have no effect on any provision in Ordinance D' 1159 which is not specifically mended hereby. Section IV. This Ordinance shall be in full force and effect as of January 1, 1996, once it has received passage, approval and signing by the Mayor. ,1996.
