AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY
OF CARMEL, INDIANA APPROVING A TRANSITION PLAN
FOR CIVILIAN EMPLOYEES OF THE CARMEL POLICE DEPARTMENT
AND THE CARMEL FIRE DEPARTMENT
WHEREAS, employees within the City of Carmel are classified as either "sworn"
or "civilian"; and
WHEREAS, sworn employees are traditionally those employees who are police
officers and firefighters and all other employees are civilian employees; and
WHEREAS, depending upon their date of hire, certain civilian employees within
the Carmel Police Department and Carmel Fire Department currently operate under
departmental rules and regulations and others operate under the Carmel City Code; and
WHEREAS, sound management policy dictates that equity and consistency govern
employment practices whenever possible; and
WHEREAS, it is in the best interest of the City of Carmel and its employees that
all civilian employees in all departments operate under the same employment policies.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of
Carmel as follows:
I. The attached Transition Plan (the "Plan") is hereby approved as an exception to
Chapter 2, Article 3, Division II, Sections 2-41 and 2-42 of the Cannel City Code, and
employees specifically listed in the Plan are hereby bound by the mandates of the Plan as it
differs from the Carmel City Code.
II. All prior Ordinances or parts thereof inconsistent with any provision of this
Ordinance are hereby repealed.
m. This Ordinance shall be in full force and effect from and after its passage and
signing by the Mayor.

TRANSITION PLAN
FOR POLICE AND FIRE DEPARTMENT CIVILIANS
VACATION TIME
The following will apply to Police and Fire employees listed at the end of this document:
1. On January 1, 1997, each employee will be credited for the number of days accrued in 1996
(up to 20); employees will also carry over any days earned in 1995 and not used in 1996 (up
to 10).
2. Those employees with thirteen (13) or more years of service, and those less than six (6)
months away from thirteen (13) years, will be grandfathered at twenty (20) vacation days
annually.
3. Those employees in years 1-5 will begin accruing one (1) day (7.5 hours) per month as of
January 1, 1997.
4. Those employees in years 6-12 will begin accruing one and one-half (1.5) days (11.25 hours)
per month as of January 1, 1997.
5. Those employees with thirteen (13) or more years will begin accruing 12.5 hours per month as
of January 1, 1997.
6. In order to spread these excess vacation days out over a two (2) year period, there will be no
limit to the number of vacation days that can be carried over at the end of 1997. The standard
ten (10) day limit on carryover will be in effect from the end of 1998 onward.
The following will apply to specified subgroups of employees:

In order that no long-term employee receives fewer than 315 vacation days in a twenty (20)
year period, certain Police Department employees will receive "catch-up" vacation days as
follows:
· employees in their seventh year as of January 1, 1997 will receive one (1) additional
day at the beginning of their thirteenth year of employment (two employees fall in this
category).
· employees in their eleventh year as of January 1, 1997 will receive two (2) additional
days at the beginning of their thirteenth through eighteenth years of employment and
one additional day at the beginning of their nineteenth year (two employees fall in this
category).
· employees in their twelt'rh year as of January 1, 1997 will receive two (2) additional
days at the beginning of their thirteenth year through twentieth years of employment
(one employee falls in. this category).
The Police Department will be responsible for keeping track of vacation days for these
employees.

"Catch-up" days are not eamed until the beginning of the years indicated (years 13-20).
Individuals who leave the City's employment prior to the year the days are earned will not be
entitled to pay for such days.
In the interest of equity, Communications Center employees who did not receive their accrued
vacation time when they became civilian employees in 1992 will be credited with that time on
January 1, 1997. The carryover limitation will be waived for these employees at the end of
1997 and reinstated at the end of 1998.
SICK TIME
The following will apply to Police and Fire employees listed at the end of this document:
1. On January 1, 1997, each employee will be credited with the number of days he or she has left
over from 1996 plus an additional twelve (12) days to a'maximum of thirty (30) days.
2. On January 1, 1997, all employees will begin accruing one (1) day per month.
3. Employees are limited to thirty (30) days carryover at the end of 1996 and therea_Rer.

Employment Issues on Council Agenda
Pursuant to our discussion of November 18, the Department of Law has prepared the following
documents for inclusion on the December 2 Council agenda:
1. Ordinance D-1261-96: This ordinance will resolve longstanding questions regarding
longevity. For purposes of calculating longevity pay and vacation accruals, employment will
be considered continuous through breaks in service of ninety (90) or fewer calendar days.
Employees returning after a break of more than ninety (90) days will be treated as new
employees.
2. Resolution CC-12-02-96-03: This resolution affects only those seven (7) employees who
have had a break in service of one (1) year or less prior to the effective date of the
abovementioned ordinance, and whose longevity status has been unclear. From January I,
1997 forward, these employees will receive credit for their initial period of employment with
the City, as long as that credit does not cause them to exceed established maximums for
longevity pay and vacation accruals. The employees will no~t be entitled to back pay or
vacation accruals.
3. Ordinance D-1262-96: This ordinance will exclude sick time from overtime calculations.
Employees will still receive paid sick days as they have in }he past, but will not be able to
collect time and one-half until their other hours, excluding sick time, exceed forty (40) in a
week (or other limits that apply to some public safety employees). All other paid time off,
including vacation and holidays, will continue to be included in Overtime calculations.
4. Resolution CC-12-02-96-02: This resolution will authorize back pay to Fire Department
employees who qualified for overtime in the period 1994-96 and, due to a misapplication of
City Code, did not receive it. The amount in question is nearly $18,000. On December 2 we
will provide an exact amount through the pay period ending November 29.
5. Ordinance D-1263-96: ,This ordinance will allow the City to carry out a plan bringing all
civilian employees within the Police and Fire departments under the employment policies
outlined in City Code.. Currently, some police and Fire civilians are governed by departmental
rules and regulations and some by City Code. In order to make the plan equitable and
administratively sound, certain exceptions to City Code are required.
