Petitioner: Wayne&Gina Nelson
1.The approval of this variance will not be injurious to the public health,safety, morals and general
welfare of the community because:The property will be used by family and friends alike and not for
general public use.The Petitioner's plan for phase II will be to erect a wrought iron fence (pending
possible varaiance) in the backyard of the property that encompasses the entire pool.The planned fence
will match and connect to the adjacent neighbors on both sides of the property.The general pool specs
are 3 to 6 feet deep with steps at the lower end for small grandkids and no diving boards.The pool
contractor is well-known in the Indiana community and has an A+rating for pool installations. Lastly,the
pool will have an auto cover for added security
2.The use and value of the area adjacent to the property included in the variance will not be affected in
a substantially adverse manner because:There are 3 existing pools within view of the Petitioners
property. 2 rear-facing the Nelson property and 1 currently adjoining and 1 future 1 pool to be installed
simultaneously with the Nelson pool project if variance is granted and affirmed by BZA.Thus, based on
the Contractor Pools of Fun that is conducting the install,the pool as planed per Exhibit A will not
encroach on either neighbors'property in any way....
3.The strict application of the terms of the Unified Development to the property will result in practical
difficulties in the use of the property because:The current 35%max coverage covenant limits the ability
to safely and aesthetically integrate the pool and associated elements into the property.The proposed
improvement is otherwise consitant with residential ordinances
DECISION
IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that Development Standards
Variance Docket No. PZ-202I-00 I$(o V is granted,subject to any conditions stated in the
minutes of this Board,which are incorporated herein by reference and made a part hereof./` %opted this
