D-1215-96 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, ENTITLED "116TH STREET PROJECT MODIFICATION" WHEREAS, on or about March 11, 1991, the 116th Street Committee presented to the Common Council of the City of Cannel a report C'Report") which recommended, among other things, that 116th Street from Keystone Avenue to the eastern city its of Carreel, Indiana C' 116th Street") be widened to three (3) lanes; and WHEREAS, the Common Council of the'City of Cannel C'Council") appropriated funds sufficient to widen 116th Street consistent with the Keport; and WHEREAS, on or about January 4, 1995, the Board of public Works and Safety ("the Board") contracted with the State of Indiana as administrator of federal funds allocated to the widening of 116th Street C'Project"); and WHEREAS, the approved design standards for the Project comemplated forty-three (43) feet from back of curb to back of curb, allowing forty (40) feet of asphalt paving; and WHEREAS, subject to Indiana Department of Transportation ("INDOT") approval, forty feet of asphalt paving is sufficiem to accommodate more than three (3) lanes; and WHEREAS, IC 36-1-3-4 grams to municipalities all powers necessary or desirable in the conduct of its affairs; and WHEREAS, the Council has received information which indicates that the Project as originally contemplated will adversely affect the public health, safety and welfare; and WHEREAS, it is in the best interest of the public that 116th Street be marked with four (4) rather than three (3) lanes. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Cannel as follows: Based on the foregoing premises, the Department of Community Services C'Department") and the Board are hereby directed to take all appropriate action to ensure that the Project be modified to include four (4) traffic lanes without jeopardizing the Project's federal funding and subject to approval by INDOT. To the extent that the Department and the Board believe that any such action will jeopardize the Project' s federal funding, the Department and the Board shall report to the Common Council for further direction.
