HomeMy WebLinkAboutD-1207-96 Amend Tranfer of FundsORDINANCE D-1207-96 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIAN& AMENDING CHAPTER 2, ARTICLE 6, DIVISION I., SECTION 2-135 OF THE CARMEL CITY CODE ENTITLED "TRANSFER OF FUNDS". WHEREAS, IC 6-1.1-18-6 requires that the proper officers of a political subdivision may transfer money from one major budget classification to another within a department or office if: (a) they determine that the transfer is necessary; (b) the transfer does not require the expenditure of more money than the total amount set out in the budget as finally determined under this article; (c) the transfer is made at a regular public meeting and by proper ordinance or resolution; and (d) the transfer is certified to the county auditor; and WHEREAS, the Indiana State Board of Accounts requires an accounting of a political subdivision's expenditures which are required to be categodzed within one of the following four (4) major budget classifications: (a) Personal Services (10,000); (b) Supplies (20,000); (c) Other Services and Charges (30,000); and (d) Capital Outlay (40,000) (collectively, (a) through (d) are the "SBA Classifications"); and WHEREAS, it is reasonable and customary for political subdivisions to consider the term "major budget classifications" as used in IC 6-1.1-18-6 to be the same classifications as the SBA Classifications; and WHEREAS, the Indiana Code does not regulate transfers between line items within a major budget - classification; and WHEREAS, the Carreel City Code, Chapter 2, Article 6, Division I., Section 2-135 requires an ordinance or resolution by the Common Council for the transfer of funds between line items within a major budget classification; and WHEREAS, the Common Council has determined that it is in the best interest of the City of Carreel, Indiana, to follow the Indiana Code and allow without ordinance or resolution the City of Carmel Officers and Department Directors to transfer appropriated funds between line items within major budget classifications. NOW THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIAN& that Chapter 2, Article 6, Division I., Section 2-135, of the Carmel City Code is hereby deleted in its entirety and replaced with the following: I. Common Council Approved Transfers. The Common Council may transfer money from one major budget classification to another within a City Department or Office of an Elected Official if: , it determines that the transfer is necessary; the transfer does not require the expenditure of more money than the total amount set out in the budget as finally determined pursuant to IC 6-1.1 et seq; the transfer is made at a regular public meeting and by proper resolution; and the transfer is certified to the county auditor. II. Department and Office Approved Transfers. a, All City Departments, the office of the Mayor, the Clerk-Treasurer, and the City Judge may transfer appropriated funds between line items within major budget classifications without the approval of the Common Council (the "Department and Office Approved Transfers"). b, Department and Office Approved Transfers may be made without notice and without the approval of the State Board of Tax Commissioners. C, Written notice of Department and Office Approved Transfers shall first be provided to the office of the Clerk-Treasurer.
