HomeMy WebLinkAboutD-1201-96 WITHDRAWNOrdinance D-iZeI-96 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF ~,, INDIANA AMENDING CHAPIflR 2, ARTICIE 1, SECTION 2-4, OF THE CARMET, CITY CODE ENTITY~D BOARD OF ttTBLIC WORKS AND SAFETY WHEREAS, .IC 8-1.5-3-3(a) provides that the legislative body of a municipality may, by ordinance, provide for the control of any or all of its municipally owned utilities by ( 1 ) the municipal works board; ( 2 ) a board consisting of the members of the municipal legislative body; (3) a utility service board established under subsection (e) or established before January, 1983, under IC 8-1-2-100 (repealed); or (4) the board of directors of a department of waterworks established under IC 8-1.5-4; and WHEREAS, Section 2-4 of the Carreel City Code establishes a Board of Public Works and Safety (the municipal works board) and gives it the responsibility of administer~ the municipally owned utilities referenced in the Carmel City Code as the "Public Water and Public Wastewater Utilities"; and WHEREAS, the Common Council wishes to amend Section 2-4 of the Carreel City Code to establish an additional board to provide for the control of any or all of its municipally owned utilities by a board consisting of the members of the municipal legislative body pursuant to IC 8-1.5-3-3(a)(2). NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, AS FOLLOWS: Section I. Chapter 2, Article 1, Section 2-4 of the Carreel City Code, is hereby amended to read as follows: "Sec. 2-4 Board of Public Works and Safety and Municipal Utility Board. (a) Board of Public Works and Safety. The is established a Board of Public Works and Safety within the executive branch. The members of the Board of Public Works and Safety are the Mayor and two (2) voters of the City who shall be chosen by the Mayor and serve at his or her pleasure. The Board shall administer all matters specifically set forth in the Indiana Code, as set forth by ordinance or pursuant to Home Rule. (b) Municipal Utility Board. There is established a Municipal Utility Board to administer the Public Water and Wastewater Utilities. The members of the Municipal Utility Board shall be the members of the Common Council." Section II. All prior Ordinances or parts thereof inconsistent with any provision of this Ordinance are hereby repealed. Section III.
