AN ORDINANCE ESTABLISHING A SPECIAL NON-REVERTING
CAPITAL FUND FOR CAPITAL IMPROVEMENTS
CONNECTED WITH EMERGENCY AMBULANCE AND
FIRE SERVICE FUND 102
WHEREAS, in 1980, the City of Carmel and Clay Township
petitioned the Board of Hospital Trustees of Riverview Hospital,
the Hamilton County Council and the Hamilton County Commissioners
to establish and approve a county-wide tax levy for the purpose of
funding an advanced life support system in Clay Township as well
as other townships within Hamilton County, Indiana; and
WHEREAS, said tax levy was established and Riverview Hospital
has been administering paramedic services for Clay Township from
1981 forward, with equipment and capital improvements supplied by
both the City of Carmel and Clay Township; and
WHEREAS, as a result of Riverview's administration of this
program, the City has received directly surplus revenues generated
by Riverview Hospital based upon paramedic services administered
by Riverview in the Township; and
WHEREAS, based upon consultation and agreement between the
Township and the City, the City desires to establish a non-
reverting capital fund to maintain excess revenues received from
Riverview for the purpose of acquiring and/or replacing capital
improvements and equipment necessary to maintain emergency
ambulance and fire service.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the
City of Carmel that the City establish a special non-reverting
capital fund for the purpose of maintaining revenues received from

Riverview for the purpose of acquiring and/or replacing capital
improvements and equipment necessary to maintain emergency
ambulance and fire service hereinafter referred to as the
"Emergency Ambulance and Fire Service Capital Fund" (hereinafter
the "Capital Fund"), to be administered and maintained by the City
of Carmel as set forth hereafter:
1) The Capital Fund will be funded from surplus revenues
provided by Riverview Hospital as a result of Riverview's
administration of the paramedic and emergency response
services and by monies previously received by the City
and deposited in the general fund as follows: July 1991
through December 1991, $3,536.00; January 1992 through
December 1992, $18,304.00; January 1993 through December
1993, $~0,S46.00; January 1994 forward, as received;
2) The funds held in the Capital Fund shall be accounted for
and maintained separate and apart from other City funds
and invested with interest thereon deposited into the
Capital Fund as provided by law;
3) The funds held and accounted for in the Capital Fund
shall be withdrawn only: a) upon proper appropriation
by the legislative body of the City of Carmel; b) upon
written agreement between the City and the Township
authorizing expenditures; and c) for the purpose of
making capital expenditures supporting emergency
ambulance and fire service;

4) Capital equipment and improvements acquired from the
funds held in the Capital Fund shall be titled in the
name of the City and/or the Township as set forth in
written agreement between the City and the Township at
the time of expenditure; and
5) At such time as Riverview terminates its administration
of paramedic services and/or the City and Township do not
provide paramedic or fire protection services to Clay
Township as a whole by joint agreement, all unexpended
funds maintained in the Capital Fund shall be distributed
to the City and to the Township based upon the City and
the Township's proportionate monetary contribution toward
fire protection of Clay Township under prior Contracts
for Fire and Protection between the City and the
Township.
The life of the Emergency Ambulance and Fire Service Capital
Fund shall be perpetual unless terminated by subsequent ordinance
duly enacted by the City of Carmel legislative body.
This ordinance shall be in full force and effect from and
after its passage by the Common Council of the City of Carmel and
its approval by the Mayor.
