WHEREAS, Ruth Sanders and Vera Bailey, as owners of the real
estate described in Exhibit "A", attached hereto and made part of
this ordinance, have petitioned the Common Council to vacate
certain public ways; and,
WHEREAS, said public ways are adjoined on the west side by

WHEREAS, notice has been given by the C~r~~
hearing conducted before this Council this date pursuant to the
requirements of IC 5-3-1 and proofs of publication having been
filed with the Clerk and receipts for certified mail notice having
also been filed with the Clerk; and, r..-. .~= .....
WHEREAS, the public good shall be served by Vacati D~..' P~bli

Ways in the following particulars:
a. the tax base of the City shall be enlarged;
b. there will be no further upkeep expense to tM"~ ~ty..~
NOW THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE
CITY OF CARMEL, HAMILTON COUNTY, INDIANA, acting pursuant to the
authority granted it in IC 36-7-3-12 as follows:
1. the following described real property consisting of public

described real estate: part of the East half of the
Southeast Quarter of the section 25, Township 18 North,
~9~ange 3 East, beginning 560.44 feet South and 468 feet
~UL ~ 1 ast, of the Northwest corner of said East half, thence
~--~outh 132 feet, West 132 feet, North 132 feet, East 132
feet to the place of beginning, being Lots 1 and 2 in
Frank M. Hawkins addition to the Town of Carmel, Indiana.
2. The Mayor and Clerk-Treasurer, on behalf of the City of
Carmel, are hereby authorized to execute any documents necessary to
carry out the intent of this resolution.
3. This ordinance shall be in full force and effect from and
upon its adoption.
4. The petitioner waives all right, title and interest to any
reversionary rights from adjoining, abutting or adjacent property
which could be acquired from the vacated parcel.
