O0~ ORDImU~CE NO b It 2-~ AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL INDIANA, AMENDING CHAPTER 8 OF THE CARMEL CITY CODE BY THE INCLUSION OF SECTION 8-3 ENTITLED OBSTRUCTION OF A MAIL BOX PROHIBITED WHEREAS, The obstruction by a vehicle of a mail box poses a nuisance to the general welfare of the citizens of the City of Camel and to the personnel who must deliver the mail, and; WHEREAS, It is in the best interest of the citizens of the City of Camel, Indiana that Chapter 8 of the Carmel City Code be amended: NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, AS FOLLOWS: Sec. 8-3 Obstruction of a Mail Box Prohibited. (a) PURPOSE. It is hereby declared to be the purpose of this chapter to prohibit the obstruction by a vehicle of a mail box in such a manner so as to impede the delivery of the mail by the United States Postal Service. (b) DEFINITIONS. (1) EMERGENCY RESPONSE PERSONNEL. An employee or employees of the Camel Police Department, Camel Clay Fire Department or Camel Clay Communications Center who routinely respond to a summons for assistance when there is a reasonable belief that the need exists. (2) MAILBOX. (a) A public container approved by the United States Postal Service for deposit of outgoing mail. (b) A private container approved by the United States Postal Service for incoming mail. (c) A person may not stop, stand, or park a vehicle in such a manner as to obstruct a mail box or to interfere with the deliver~ of mail by the United States Postal Service. Vehicles following the direction of a law 1L/28/94 09:14 ALAN ~OTAS~IK 317-253-3233--- p.002 enforcement officer or traffic control device, emergency response personnel attending to an emergency call, United States Postal Service vehicles, and individuals stopped for the sole purpose of placing or removing mail from a mail box are exempted from this section. ( i ) ENFORCEMENT. (1) Enforcement or this provision shall be by the city attorney. (j) SCHEDULE OF CODE PROVISIONS AND PENALTIES. (1) Vehicles found to be in violation of this section shall be discharged subject to removel proceedures as designated in Section 6 of this Code. (1) SAVINGS CLAUSE. Should any provision of this section be determined by any Court of competent jurisdiction to be unenforceable, the remaining provisions shall remain in full force and effect, the same as if the unenforceable provision were deleted from the Section.
