FundORDINANCE D-887 AN ORDINANCE ESTABLISHING A SPECIAL NON-REVERTING OPERATING FUND FOR THE CARMEL/CLAY BOARD OF PARKS AND RECREATION WHEREAS, the Carmel/Clay Board of Parks and Recreation ("Board"), under the provisions of IC 36-10-3 of the State of Indiana, hereinafter referred to by its short title, to-wit, "The Park and Recreation Law" is empowered where necessary in order to provide a particular park and recreation activity to charge a reasonable fee; and, WHEREAS, the Common Council of the City of Carmel, under the "Park and Recreation Law" is empowered to create a special non-reverting operating fund into which moneys procured from such activities shall be deposited with the Fiscal Officer of the Township as provided in IC 36-10-7.5-20(f) and the Joinder Agreement; and, WHEREAS, the Common Council of the City of Carmel is empowered by the "Park and Recreation Law" to provide by ordinance that expenditures may be made from the special non-reverting operating fund by appropriation of the Board: NOW, THEREFORE, BE IT ORDAINED by the Common Council of Carmel, Indiana, as follows: SECTION I Under the provisions of the "Park and Recreation Law" there is hereby established a special non-reverting operating fund created from moneys and fees procured from park and recreation activities, including but not limited to swimming pools, skating rinks, fun runs, arts, and crafts. All moneys from these and other activities shall be deposited with the fiscal officer of the Township as provided by IC 36-10-7.5-20(f) and the Joinder Agreement. SECTION II Under the provisions of the "Park and Recreation Law" expenditures may be made from the special non-reverting operating fund by the Board upon approved claims in the same manner as all other Board claims. SECTION III The life of the operating fund shall be perpetual until terminated by subsequent ordinance duly enacted by the governing body herein. SECTION IV This Ordinance shall be in full force and effect from and after its passage by the Common Council and approved by the Mayor.
