AN ORDINANCE ESTABLISHING THE POSITION
OF DEPUTY MAYOR THE CITY OF CARMEL,
HAMILTON COUNTY, INDIANA
WHEREAS, there exists from time to time a need within the
Executive Branch of Government of the City of Carmel to have the
timely assistance of a Deputy during the absence of the Mayor in
the day-to-day operations of the Executive Branch of City of
Government; and,
WHEREAS, pursuant to provisions of Indiana Code 36-4-9-7, it
is incumbent upon the City legislative body by ordinance to
establish the position of Deputy Mayor to serve as the City
Executive's Deputy.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the
City of Carmel, Hamilton County, Indiana, as follows:
Section 1. Establishment. The Common Council of the City of
Carmel, Hamilton County, Indiana, does hereby establish the
position of Deputy Mayor to serve as the City Executive's Deputy
pursuant to the provisions of Indiana Code 36-4-9-7.
Section 2. Appointment and Service. The position of Deputy
Mayor shall be filled by appointment of the Mayor and the
individual so appointed shall serve at the pleasure of the Mayor of
the City of Carmel. The appointee shall be a resident of Carmel
and must meet the same residency requirements as did the Mayor when
he was elected to office. The appointment shall be made in writing
and the individual so appointed shall take an oath of office before
assuming the responsibilities of Deputy Mayor.
Section 3. Powers of the Deputy Mayor. The Deputy Mayor
shall exercise all of the powers of the City Executive as specified
by the laws of the State of Indiana as from time to time amended.
The powers of the Deputy Mayor shall not exceed the powers of the
Executive as provided for by the laws of the State of Indiana as
from time to time amended.
Section 4. Exercise of Powers. The deputy Mayor shall not
exercise any powers of the Executive except upon designation by the
City Executive pursuant to the provisions of Indiana Code 36-4-5-8.
Section 5. Compensation. The position of Deputy Mayor would
not receive compensation or benefits performing the job description
of Deputy Mayor.
Section 6. Effective Date. This ordinance shall be in full
force and effect from and after its passage and any prior
ordinances in conflict herewith in whole or in part are repealed.
Section 7. Termination Date. This ordinance shall terminate
at 12:00 a.m. January 1, 1996.
