D-836 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, AMENDING CHAPTER 9, ARTICLE 2, SECTION 9-62, OF THE CARMEL CITY CODE BY THE AMENDMENT OF SUBSECTION (a) AND THE INCLUSION OF SUBSECTION (b) ENTITLED "RETURNED CHECKS; DISCONNECTION FOR NONPAYMENT." WHEREAS, the Common Council of the City of Carmel, Indiana has determined that a provision for penalties resulting from the payment of water service with checks returned to the City unpaid and to provide for a reconnect fee would be in the best interest of the City of Carmel; NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL, OF THE CITY OF CARMEL, INDIANA, AS FOLLOWS: Section I. Chapter 9, Article 2, Section 9-62, of the Carmel City Code is hereby amended to read as follows: Sec. 9-62. Disconnection for Non-Payment; Returned Checks. (a) Water service shall be disconnected from those water customers of the Carmel City Utilities who fail to pay the accrued fees and late charges within sixty (60) days of billing. The service cannot be continued until all fees are paid, including a Twenty Dollar ($20.00) reconnect fee. The water service can only be reconnected by a Carmel Water Company employee. (b) If the City of Carmel receives a check for payment of a water and/or sewer bill, and said check is returned for insufficient funds, the City may assess a fee of Twenty Dollar ($20.00) in addition to all other applicable charges, and water service may be disconnected or new water service may be denied on other properties until the account is brought current. Cash, cashier's check or money order will be required to pay all such charges. Section II. All prior Ordinances, resolutions or parts thereof inconsistent with any provision of this Ordinance are hereby repealed. Section III.
