D-833 Weed,Debris ViolationsOld. No. D-833 Division II. Weeds and Debris AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, AMENDING CHAPTER 6, ARTICLE 5, SECTION 6-88 and 6-89, OF THE CARMEL CITY CODE. WHEREAS, the City of Carmel enacted and codified an Ordinance regulating the control of weeds, debris, and other such rank vegetation within the City of Carmel and Clay Township; WHEREAS, it is in the best interest of the citizens of the City of Camel and Clay Township, Indiana, that said ordinances be repealed in their entirety and replaced with the following: NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, AS FOLLOWS: Division II. Weeds, Debris, and Other Such Rank Vegetation. Sec. 6-88 Rsmoval of Weeds, Debris, and Other Such Rank Vegetation. (a) Definitions: "Rank vegetation" shall include those weeds and growing vegetation which is excessively vigorous in growth, shockingly conspicuous, malodorous, or flagrant. "Debris" shall include the remains of something broken-down or destroyed. (b) All owners of real estate located within the City of Carmel shall cut and remove weeds and other rank vegetation growing thereon and shall keep their property clear of miscellaneous debris. (c) The Director of the Department of Community Development, City Engineer, or an officer of the Carmel Fire Department is directed and authorized to issue a five (5) day written notice to the owner to remove such debris, weeds, or other rank vegetation. Such notice may be served either personally on the owner or sent by certified mail with a return receipt requested, addressed to his last known address, if he is a nonresident of the city. (d) If the landowner fails to remove such debris, weeds or other rank vegetation within the time prescribed, the respective city official may cause such debris, weeds or rank vegetation to be cut and/or removed. The Clerk-Treasurer shall make a certified statement of the actual cost incurred by the city in such cutting and removal, which statement shah be delivered to the owner of the real estate by a member of the Carmel Police Department, or by certified mail with a return receipt. The owner shall, within ten days from receipt of such notice, pay the amount to the Clerk-Treasurer. See. 6-89 Collection of Monies from Property Owners If the owner fails to pay said sum assessed for the removal and/or cutting of the debris, weeds, or rank vegetation within the time prescribed, the Clerk-Treasurer shall file a certified copy of the statement of costs in the Auditor's office of Hamilton County, and the Auditor shall place the amount so claimed on the tax duplicate against the lands of the landowner affected by the lien, and the same shall be collected as taxes disbursed to the General Fund of the city. Section II. All prior Ordinances or parts thereof inconsistent with any provision of this Ordinance are hereby repealed. Section III. This Ordinance shall be in full force and effect from and after its passage and signing by the Mayor.
