THE INCLUSION OF SUBSECTIONS (a) THROU(]H
'BUILDIN(] PERNITS, REGISTRATION AND LICENSURE
OF CONTRACTORS AND FEES'
WHEREAS, the Common Council of the City of Carmel, Indiana,
determined that an ordinance regulating the licensure and
registration of individuals, firms and corporations providing
services as general contractors to real property owners within the
City of Carmel and Clay Township, Hamilton County, Indiana, would be
in the best interest of said citizens;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY
OF CARMEL, INDIANA, AS FOLLOWS:
Section I. Chapter 4, Article 1, Section 4-22 of the Carmel
City Code is hereby amended to read as follows:
Building Permits, Registration and Licensure of
Contractors, and Fees.
(a) BUILDING PERMITS AND FEES.
Specific provisions governing the requirements for building
permits and fees may be found in Chapter 7 of this Code.
(b) REGISTRATION AND LICENSURE OF CONTRACTORS AND FEES.
(1) Any person, partnership or corporation which has For

person, partnership or corporation which holds a property
interest in the real estate located within the City of
Carmel or Clay Township on which the construction is
occurring must be a registered contractor under the
provisions of this Section to engage in any type of
construction requiring a permit pursuant to Section 7-10 of
the Building Code for the City of Carmel.
(2) Contractors of all trades shall be required to file a
"General Contractor's Registration" with the Department of
Community Development (DOCD), City of Carmel, Indiana,
prior to the issuance of any Improvement Location Permit
(Building Permit). General Contractors shall include, but
shall not be limited to, such trades as framers, masonry
workers and demolition workers. Trades specifically
required to be licensed, in addition to registration, shall
include electrical contractors and heating, ventilation and
air conditioning (HVAC) contractors. Plumbers currently
licensed through the State of Indiana are required to
register with the City of Carmel.
(c) ANNUAL FEE.
(1) Contractor Registration Fee
$75.00 annually
Items required':
1. Posting of $10,000 surety bond to the City
of Carmel.
2. Proof of insurance and workman's
compensation coverage.
The term "contractor" shall include all construction trades,
such as, but not limited to, general contractors, sub-contractors,
plumbing contractors, electrical contractors, HVAC contractors, etc.
(2) Electrical and HVAC
Contractor Licensure
$100.00 each annually
Through a reciprocal agreement between the City of Carmel and
the City of Indianapolis, accredited testing will be conducted and
recognized by each entity for the purpose of licensure. Testing
will be conducted by the Indianapolis Department of Metropolitan
Development. Dates, times and locations for testing will be
available in the Department of Community Development.
There are two (2) areas of licensure for electrical
contractors: residential and commercial.
There are two (2) areas of licensure for HVAC contractors:
residential and commercial.
Contractors with all licenses in a given trade will be
designated in the Carmel Register of General Contractors as "Master"
(i.e. Master Electrician, Master HVAC Contractor).
(d) LICENSE REVIEW BOARD.
(1) The License Review Board (Review Board) shall be made
up of five (5) individuals of competent experience and
shall be persons listed and/or licensed pursuant to this
Section. The members of this Review Board shall be
appointed by the Mayor. Two appointments shall be licensed
electricians (one residential and one master), two
appointments shall be licensed HVAC contractors (one

residential and one master), and one appointment shall be a
listed general contractor. Each member of the Board shall
be a resident of or operate a business in the city of
Carmel and have at least five (5) years experience in
his/her respective trade and hold no other appointive or
elective office.
(2) The five (5) voting members of the Review Board shall
be appointed for two (2) year terms in such manner that two
(2) terms expire on January 1st of one year and three (3)
other terms expire on January 1st of the next year.
(3) Prior to examination a contractor shall make
application to appear before the Review Board. The Review
Board will evaluate the applicant's background, experience
and references in order to determine the applicant's
potential for succsss or failure of the examination. A
report will be completed and made available to the
applicant.
(4) If the report is favorable, it will be directed to the
Carmel DOCD. The DOCD will assist the applicant in
scheduling the examination. The examination will be
conducted by the Indianapolis Department of Metropolitan
Development, Division of Development Services.
(5) Upon receipt of examination scores, individuals with
passing scores may apply for issuance of a license by the
City of Carmel through the Office of DOCD.
(e) GRANDFATHERED INDIVIDUALS.
(1) Individuals who have performed work within the past
five (5) years (between the years 1987 and 1992) in a trade
now requiring licensure by the City of Carmel may be
allowed to obtain a license without taking the examination
("grandfather status"). Each individual wishing to qualify
for grandfather status shall present proof of work
performed in the past five (5) years, with references, to
the License Review Board. It is the duty of the Board to
justify the validity of the claims made by the individual
seeking grandfather status, to review any public objections
and to approve or deny the request.
(2) All requests for grandfather status must be made within
twelve (12) months from final approval of this Ordinance.
A denial by the Board of anyone requesting grandfather
status does not preclude that individual from requesting
licensure by examination.
(3) Grandfather status will only be recognized by the City
of Carmel for construction within its jurisdiction.

(f) INSPECTOR STATUS.
A person who is employed full time by the DOCD in a
position in which he makes or supervises the making of
inspections to determine compliance with the building
standards of the State of Indiana and the City of Carmel
qualifies for a license issued under this Subsection as an
inspector. Such person shall not use said license as any
type of contractor other than with respect to employment by
the City of Carmel. Licensure under the terms of this
Section terminates by operation of law when the person is
no longer employed by the DOCD for the City of Carmel,
Indiana.
(g) Individuals who have a current license through the
Indianapolis Department of Metropolitan Development shall
be recognized as licensed by the City of Carmel once the
individual has paid the registration and license fees to
the City of Carmel. Future reciprocal agreements will be
determined by the Review Board.
Section II. All prior ordinances or parts thereof inconsistent
with any provision of this Ordinance are hereby repealed.
Section III. This Ordinance shall be in full force and effect
from and after its passage and signing by the Mayor.
