The committee has approved your amended request (either concrete or
paver) with the following conditions:
1. There are no permanent structures (i.e. buildings/retaining
wall/constructed improvement with foundation) located with the
established drainage easement.
2. The homeowner understands and agrees that if the improvements
within the easement are ever disturbed by any entity having rights to the
easement area, there is no obligation by that entity to restore or replace
the disturbed area. All necessary restoration/repair is the sole
responsibility of the homeowner.
3. Homeowner shall provide a copy of the City of Carmel approved
Encroachment Permit to me and Robin Guyon for the HOA records.
