D-1549-01 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, AMENDING ORDINANCE NO. D-1538-01 (AN ORDINANCE AMENDING THE CARMEL CITY CODE CHAPTER 8, ARTICLE S, SECTIONS 8-45 THROUGH 8-54, INCLUSIVE, AND SECTIONS 8-58 THROUGH 8-59, INCLUSIVE, AND CHAPTER 8, ARTICLE 8, SECTIONS 8-91 THROUGH 8-93, INCLUSIVE) WHEREAS, it is in the public interest to enact and enforce motor vehicle parking regulations within thc City's corporate limits; and WHEREAS, the City's current parking ordinances should be revised to eliminate redundancies and foster clarity and readability. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel, Indiana, as follows: 1. The foregoing Recitals are fully incorporated herein by this reference. 2. Chapter 8, Article 5, Sections 8-45 through 8-54, inclusive, of the Carmel City Code are hereby amended and shall read as follows: "ARTICLE 5. Parking Regulations. Section 8-45. General Provisions. (a) The provisions contained in Chapter 8, Article 5 of the City Code apply to all vehicles, whether they are self-propelled, animal drawn or towed, except for: (i) emergency vehicles when responding to an emergency call or in pursuit of an alleged law violator, (ii) highway construction vehicles when engaged in construction work, and (iii) other vehicles that are exempt from municipal parking ordinances under applicable law. (b) The fine for the violation of any provision of Article 5 of this Chapter shall not exceed the sum of Five Hundred Dollars ($500.00) per violation, each day constituting a separate violation. In addition to the fine assessed pursuant to this Section, a vehicle violating any provision of Article 5 of this Chapter may be towed and impounded at the owner's expense, such towing and impoundment costs to be paid in full prior to the release of said vehicle. Sponsor(s): Councilors Kirby, Wilson & Caner (c) Any police officer who observes the violation of any provision of Chapter 8, Article 5 of the City Code shall attach to the offending vehicle a notice to the owner/ operator thereof that such vehicle has been parked in violation of same and advising that such person may, within seven (7) days from the date of such notice, pay to the Carmel City Court, as a fine for and in full satisfaction of such violation, the sum of Ten Dollars ($10.00), except that, in the case of a vehicle that is unlawfully parked in a properly marked handicapped parking space, such fine shall be in the sum of Fifty Dollars ($50.00). Upon the failure of the owner/operator to make such payment within the seven (7) day period, the original parking fine shall increase from Ten Dollars ($10.00) to Twenty Dollars ($20.00) or from Fifty Dollars ($50.00) to Seventy Dollars ($70.00), as applicable. If this enhanced parking fine is not paid in full, through the City Court's violations bureau, on or before the date and time set forth on the parking ticket for the City Court hearing on the parking violation~ the owner/operator who has been issued said ticket shall be required to appear before the City Court and be subject to the general penalties provided for violations of the provisions of Article 5 of this Chapter. Nothing contained in this sub-section shall limit the City's fight to also tow and impound any vehicle found to be parked in violation of any provision of Article 5 of this Chapter, the costs of such towing and impoundment to be paid by the vehicle owner in addition to the payment of any fine assessed hereunder. (d) All fines received by the City Court for violations of Article 5 of this Chapter shall be deposited into the City's General Fund pursuant to applicable law. (e) The use of any resident or merchant vehicle sticker in violation of Article 5 of this Chapter shall void the sticker and make the registered owner of the vehicle to whom the sticker was issued ineligible to obtain another such sticker for a period of one (1) year from the date of such violation. Any vehicle that displays a resident or merchant vehicle sticker that was not issued to that vehicle may also be ticketed, towed and impounded pursuant to sub-section (c) above. The City Court shall have jurisdiction over all violations of the provisions of Article 5 of this Chapter. Section 8-46. General Parking Restrictions. (a) No person shall stand or park any vehicle on a City street other than parallel with the edge of the street, headed in the direction of lawful traffic movement and with the right-hand wheels of said vehicle within twelve (12) inches of the curb or edge of the street, except on streets approved for angle parking and identified as such by appropriate signs or markings. (b) No freight carrying vehicle of one (1) ton capacity or more nor any vehicle more than twenty (20) feet in length shall park upon any City street except when engaging in lhe loading or unloading of freight. (a) No person shall park a vehicle at any time in the following locations: (1) On either side of 1st Avenue N.E. from East Main Street north to 1st Street N.E.; (2) On the south side of 1st Street N.E. from North Range Line Road east to 4th Avenue N.E.; (3) On thc east side of 1st Avenue S.E. from East Main Street south to 6th Street S.E.; (4) On the south side of East Main Street from 1st Avenue S.E. east to U.S. 431 (Keystone Avenue); (5) On the south side of 2"d Street N.E. from North Range Line Road east to fi~ 4~h Avenue N.E.; (6) On the east side of 1~t Avenue S.W. from 3~d Street S.W. south to thc termination of 1't Avenue S.W.; (7) On North Range Line Read from the entrance of Eagle Creek Nursery north to 146th Street; (8) On either side of 3r~ Street S.W. from First Avenue S.W. west to 2nd Avenue S.W.; (9) On either side of 2"d Avenue S.W. from 3r~ Street S.W. north to 1st Street S.W.; (10) On either side of Sylvan Lane; (11) On either side of Audubon Drive for a distance of four hundred (400) feet from the intersection of Audubon Drive and 2nd Street N.E.; (12) On thc west side of 4t~ Avenue S.E. from East Main Street south to Carmel View, West Drive; (13) On either side of Carmel Drive from its intersection with Keystone Avenue west to its intersection with U, S. Highway 31; (14) On the north side of 2"d Street N.E. between 4th Avenue N.E. and the Carmel High School parking lot; Sponsor(s): Councilors Kirby, Wilson & Caner (15) (16) (17) 08) 09) (20) (22) (23) (24) (25) (26) (2?) On the east side of 3~ Avenue N.E, from 1~t Street N.E. north to 2nd Street N.E.; On the north side of Ist Street S.E. from 1st Avenue S.E. to Lions Club Parking Lot; On the north side of 3ra Street S.E. from Range Line Road to 1't Avenue S.E.; On the north side of 5th Street N.E. from Range Line Road to Audubon Drive; On the north side of 7th Street N.E. from 1st Avenue N.E, to 2n~ Avenue N.E.; On the north side of 5n Street N.W. from 1st Avenue S.W. to Range Line Road; On the south side of 4th Street N.W. from the Monon Trail to Range Line Road; On the east side of North Range Line Road from its intersection with U. S. Highway 31 to a point one hundred seventy-five 075) feet south of the intersection of Cool Creek Boulevard and North Range Line Road; On the east side of Veterans Way nmning between Carmel Civic Square and City Hall; On either side of Aumrm Audubon Drive fi.om 2"~ Avenue N.E. to Carmel High School; In the ten (10) City employee parking spaces located immediately east of the reserved handicapped parking space in the Carmel Communication Center parking lot; On any Carmel-Clay Schools property posted with "No Parking" or other appropriate signage; On either side of Gradle Drive from its intersection with SW 3~ Avenue east to the west entrance of Civic Square; (b) (c) Sponsor(s): Councilors Kirby, Wilson & Caner Notwithstanding the above, the provisions of sub-section (a) (1 through 24) shall not apply to any vehicle which properly displays a valid resident vehicle sticker issued pursuant to this sub-section. Resident vehicle stickers shall, upon request, be issued hereunder by the Carmel Police Department for any vehicle registered to an owner who resides at an address which abuts any of thc above streets and for any leased, rented or employer-owned vehicle or vehicle containing valid dealer plates which is being lawfully driven by a person who resides at such address. Temporary resident vehicle stickers shall be issued, upon request, to the guests of such residents. Resident vehicle stickers shall be issued at no cost and are not transferable. The provisions of subsection (a) (25) shall not apply to any vehicle driven by a City employee and so parked In the course of such person's employment by the City. The Carmel Street Department shall post appropriate "no parking" signs or markings at the above locations and indicate thereon that such locations are "tow away" zones. Section 8-48. Limited Parkin~ Areas. (a) Three (3) hour parking zones are established in the following parking lots: (l) The parking lot located on the north side of Main Street in the first block west of Range Line Road. This lot is generally bounded on the south by Main Street, on the west by the building located at 38 West Main Street, on the north by an east-west alley between Main Street and 1st Street N.W., and on the east by the building located at 26 West Main Street. A three-hour parking lhnitation shall apply to this lot between the hours of 8:00 a.m. EST and 6:00 p.m. EST daily. (2) Thc parking lot on the south side of Main Street in the second block east of North Range Line Road. This lot is generally bounded on the north by the building located at 151 East Main Street, on the east by buildings contained within the Park Lane Apartments located on Bryn Mawr lame, on the south by the building located at 170 Carmel View Drive, and on the west by the buildings located at 121 Ist Street S.E. and 131 1st Avenue S.E. A three-hour parking limitation shall apply to this lot between the hours of 6:00 a.m. EST and 9:00 p.m. EST daily. (3) The Monon Trail parking lot abutting 2"d Avenue S.W. from Street S.W. south to 2na Street S.W. Sponsor(s): Councilors Kirby, Wilson & Carter (b) Notwithstanding the above, the provisions of sub-section (a) shall not apply to any vehicle which properly displays a valid merchant vehicle sticker issued pursuant to this sub-section. Merchant vehicle stickers shall, upon request, be issued hereunder by the Carmel Police Department for any vehicle registered to or lawfully controlled and driven by a person who is employed by a merchant located within one (1) mile of either parking lot identified in sub-section (a) above. A merchant vehicle sticker shall authorize the vehicle to which it is issued to park in a parking lot identified in sub-section (a) above while the registered owner or operator thereof is at work within the City's corporate limits, and for thirty (30) minutes before and after such person's work shift. Merchant vehicle stickers shall be issued at no cost and are not transferable. (c) The Cannel Street Department shall post appropriate signs or markings setting forth the above parking limitations and indicating that the above locations are "tow away" zones. (d) Two (2) hour parking zones are established on the following City streets: (1) On the north side of Main Street between 1s~ Avenue N.E. and 4t~ Avenue N.E., at any time; (2) On the north side of 1st Street N.E. between 4th Avenue N.E. and 3~d Avenue N.E. A two-hour parking limitation shall apply at this location from 8:00 a.m. EST to 3:00 p.m. EST, Monday through Friday; (3) On the first half (closest to Main Street) of the west side of 1st Avenue S.E. A two-hour parking limitation shall apply at this location from 8:00 a.m. EST to 5:00 p.m. EST, Monday through Frida~ (4) On both sides of Main Street between its intersection with the Morion Railway corridor and its intersection with 4th Avenue N.E. and S.E. A two-hour parking limitation shall apply at this location from 7:00 a.m. EST to 5:00 p.m. EST, Monday through Saturday. (c) The Cannel Street Department shall post appropriate signs or markings setting forth the above parking limitations and indicating that the above locations are "tow away" zones. Sponsor(s): Councilors Kirby, Wilson & Carter (i) 0) (k) No vehicle shall be parked: (1) On either side of Lincoln Court within two hundred seventy-five feet (275') east of the center point of the intersection of Lincoln Court and Lexington Boulevard at any time between 8:00 a.m. EST and 8:00 p.m. EST; (2) On either side of Emerson Road from its intersection with Guilford east for one-half (¼) block at any time between 2:00 p.m. EST and 4:00 p.m. EST, Monday through Friday; (3) On either side of Range Line Road from Main Street north to 8th Street at any time between 6:30 a.m. EST and 8:30 a.m. EST, Monday through Saturday; and (4) On the east side of Rohrer Road from its intersection with 146th Street south to a location nine hundred eighty (980) feet south of such intersection. Notwithstanding the above, the provisions of sub-section (i) shall not apply to vehicles which properly display a valid resident vehicle sticker issued pursuant to this sub-section. Resident vehicle stickers shall, upon request, be issued hereunder by the Carmel Police Department for any vehicle registered to an owner who resides at an address which abuts, and for any leased, rented or employer-owned vehicle or any vehicle containing valid dealer plates which is being lawfully driven by a person who resides at an address which abuts, any of the following City streets or street segments: (1) Lincoln Court; (2) Lexington Boulevard between its intersection with Lincoln Court and its intersection with Concord Court; (3) Lexington Boulevard from its merge with Lincoln Court to its intersection with Altam Avenue; (4) Emerson Road from its intersection with Guilford east for one (1) block. Resident vehicle stickers shall be issued at no cost and are not transferable. The Cannel Street Department shall post appropriate signs or markings setting forth the above parking restrictions and indicating that the above locations are "tow away" zones. Sponsor(s): Councilors Kirby, Wilson & Caner (1) No vehicle shall be parked at any of the following locations at anytime from 3:00 a.m. EST and 5:00 a.m. EST: (1) The parking lot located on the north side of Main Street in the first block west of Range Line Road. This lot is generally bounded on its south side by Main Street, on its west side by the building located at 38 West Main Street, on its north side by the east-west alley between Main Street and 1st Street N.W., and on its east side by the building located at 26 West Main Street. (2) The parking lot located on the north side of 1~t Street S.E. and immediately east of the north-south alley which is approximately half way between 1st Avenue S.E. and Range Line Road and directly behind the building located at 3l South Range Line Road. (m) No vehicle, except for a vehicle owned or controlled by the City of Carmel, shall be parked in the south parking lot of Carmel City Hall at any time between 10:00 p.m. EST on Friday evening until 6:00 a.m. EST on Saturday morning. (nm) The Cannel Street Department shall post appropriate signs or markings setting forth the above parking limitations and indicating that the above locations are "tow away" zones. Sec. 8-49 through 8-54 are reserved for future use." 3. City Code Sections 8-58 through 8-59, inclusive, should be and the same are hereby deleted in their entirety and are reserved for future use. 4~ Chapter 8, Article 8, Sections 8-91 through 8-93, inclusive, of the Carmel City Code are hereby amended and shall read as follows: "Sec. 8-91. Municipal Traffic Violations - Penalties. The penalty for each separate violation of any provision under City Code Sections 8-3 through 8-44, inclusive, Sections 8-55 through 8-57, inclusive, and Sections 8-60 through 8-89, inclusive, shall not exceed the sum of Five Hundred Dollars ($500.00). Sec. 8-92. City Court Jurisdiction. In addition to any other jurisdiction the Carmel City Court may have, such Court shall also have jurisdiction over all violations of City Code Sections 8-3 through 8-I 19, inclusive. Sec. 8-93 through 8-119 reserved for future use." 5. All prior ordinances or parts thereof inconsistent with any provision of this Ordinance are hereby repealed as of the effective date of this Ordinance. I! If any portion of this Ordinance is for any reason declared to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portions of this Ordinance so long as enforcement of same can be given the same effect. 7. This Ordinance shall be in full force and effect from and after its passage, signing by the Mayor and such publication as is required by law.
