The Applicant, Andrius Doniela seeks the following development standards variance approval:
Docket No. PZ-2021-00210 V UDO Section 5.09.13 — Maximum 42" front yard fence height
allowed and the Applicant is requesting a 60" inch fence height.
Statement of Variance:
To increase the height of the proposed wrought iron decorative fence from 42 inches to 60
inches.
Article 5.09 FW-01 limits fences in the front yard of a residence to 42 inches in height.
The requested increase in height of 18 inches would complement the appearance of the fence and
match a corresponding fence across Ditch Road from Applicant's property.
Statement of Support:
The additional fence height requested is consistent with fences of like appearance along Ditch
Road and along 116th Street. The Ordinance permits a 42-inch-tall fence, and the Applicant seeks
a 60-inch-tall fence.

The approval of this variance will not be injurious to the public health, safety, morals,
and general welfare of the community because:
The requested additional fence height will be consistent with similar fences in the area,
does not affect public health, morals and general welfare and does not create a vision
impairment for adjacent traffic.
2. The use and value of the area adjacent to the property included in the variance will not be
affected in a substantially adverse manner because:
The requested fence height is consistent with other properties in the area which have not
had a negative impact on the use or value of area properties.
3. The strict application of the terms of the Unified Development Ordinance to the property
will result in practical difficulties in the use of the property because:
The Estate appearance of the fence increased in height by 18 inches will be consistent
with adjoining properties and add to the physical appearance of the frontage of the
Applicant's residence.
DECISION
It is therefore the decision of the Carmel Board of Zoning Appeals that Development Standards
Variance Docket No. PZ-2021-00210 V is granted, subject to any conditions stated in the minutes
of this Board, which are incorporated herein by reference and made a part hereof.
