ORDINANCE D-1519-01
AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF
CARMEL, INDIANA, AMENDING ORDINANCE D-1467-00, SECTION 22(b)
WHEREAS, on August 7, 2000, the Carmel Common Council passed Ordinance
No. D-1467-00, fixing the salaries of appointed officers and employees of the City of
Carmel; and
WHEREAS, Section 22(b) of said ordinance entitles all full-time employees,
including non-exempt employees, of the Department of Community Services to receive a
$75 stipend in addition to their regular salary for each after-hours meeting of the Plan
Commission or the Board of Zoning Appeals they are required to attend; and
WHEREAS, the use of a stipend as an alternate method of employee
compensation may lead to pay inequities between City employees performing similar
duties, and to the possibility of a Fair Labor Standards Act violation, neither of which is
in the City's best interests.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of
Carmel, Indiana, as follows:
Section I: Ordinance D-1467-00, Section 22(b) is amended to read as follows:
(b)
Exempt employees of the Department of Community Services shall be
entitled to receive a stipend of $75.00 per meeting, in addition to their
regular compensation, for attending each regular or special meeting of the
Plan Commission or Board of Zoning Appeals, or their respective
committees or task forces, if such meetings are held outside the regular
working hours of 8:00 a.m. to 5:00 p.m. Meeting stipends shall be paid from
the budgets of the Plan Commission and the Board of Zoning Appeals, as
applicable.
For all other meetings that occur outside regular working hours, and that
cause the aforementioned exempt employees to work in excess of 40 hours
per week, the employees shall be eligible for compensatory time off only, as
outlined in the City's overtime policy. Under no circumstances shall an
exempt employee of the Department of Community Services be entitled to
both a meeting stipend and compensatory time off for attending the same
meeting.
Non-exempt employees of the Department of Community Services shall be
entitled to overtime compensation for attending regular or special meetings
of the Plan Commission or Board of Zoning Appeals, or their respective
committees or task forces, if such meetings cause them to work in excess of
37.5 hours per week. Overtime compensation for these meetings only shall
be paid from the budgets of the Plan Commission and the Board of Zoning
Appeals, as applicable. All other overtime compensation shall be paid from
the Department's overtime budget.
Section II: All prior Ordinances or parts thereof inconsistent with any provision of this
Ordinance are hereby repealed.
Section III: This Ordinance shall be in full force and effect from and after its passage
and signing by the Mayor.
