ORDINANCE NO. D-1520-01
AN ORDINANCE OF THE COMMON COUNCIL OF THE
CITY OF CARMEL, INDIANA VACATING PUBLIC RIGHT-OF-WAY
BE IT ORDAINED by the Common Council of the City of Cannel, Indiana, as follows:
That the Petition To Vacate Public Right-of-Way flied with the City of Carmel, Indiana, by
Ben Mar, LLC, and dated February 26, 2001, is hereby granted.
That the right-of-way of Keystone Way and Keystone Way East, as described in Exhibit 'A'
and Exhibit 'B' respectively, is no longer useable or needed for roadway purposes and is
hereby vacated in accordance with Indiana Code 36-7-3-12.
That title to the real estate to be vacated, more particularly described in Exhibits "A" and
"B", respectively, shall revert to Ben Mar, LLC as the owner of the abutting and adjacent
land.
This Ordinance shall be in full force and effect from and after its passage and signing by the
Mayor and such publication and recordation as is required by law.

PETITION TO VACATE PUBLIC RIGHT-OF-WAY
Gary Linder, the Managing Member of Ben Mar, LLC, ("Petitioner"), pursuant to Indiana Code 36-7-3-12, in support
of this Petition To Vacate Right-of-Way to the City of Cannel, Indiana, alleges and says:
That Bm Mar, LLC is the owner of the real estate in Hamilton County, Carmel, Indiana, conanonly known
as Merchants' Square.
That the intersection of the public ways, known as Keystone Way and Keystone Way East, exists within the
perimeter locationofMerchants' Square. ("Intersection").
That as part of the redevelopment of Merchants' Square, the Intersection was reconfigured and realigned
creating a part of the dedicated right-of-way of Keystone Way and Keystone Way East, no longer useable or
needed for roadway purposes. ("Abandoned Right-of-Way').
That the Abandoned Right-of-Way is legally described on Exhibit 'A' and Exhibit 'B' attached hereto.
("Vacated Right-of-Way").
That the Petitioner is the sole owner of the real estate abutting the Vacated Right-of-Way and has a common
address of 8555 River Road, Indianapolis, 1N 46240.
WHEREFORE, Petitioner requests that the Common Council of the City of Carmel, Indiana, adopt an ordinance
vacating the Vacated Right-of-Way.
