D-1527-01 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA ESTABLISHING A RECORD PERPETUATION FUND AND ALLOWING THE COLLECTION OF FACSIMILE TRANSMISSION FEES WHEREAS, THE Indiana General Assembly enacted Public Law 183, Acts 0f2001, which is effective July 1, 2001, requiring city and town courts to collect document storage fees in all civil, criminal, infraction and ordinance violation cases, and WHERESAS, said Public Law requires all document storage fees to be deposited in a clerk's record perpetuation fund, and WHEREAS, the City of Carmel has no clerk's record perpetuation fund, but has the immediate need to establish same, so that the document storage fees required by law to be collected can be deposited therein, and WHEREAS, Indiana law, specifically I.C. 33-19-6-5.1, allows courts to collect facsimile transmission fees for facsimile transmissions made to the Indiana Bureau of Motor Vehicles, and WHEREAS, said facsimile transmission fees are also required to be deposited into the clerk's record perpetuation fund, NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel, Indiana, as follows: Section I: The Cannel City Court is authorized to assess and collect facsimile transmission fees, in the amount of five dollars ($5.00) per transmission, for each facsimile transmission made to the Indiana Bureau of Motor Vehicles at the request of any person. Section II: The Council hereby creates and establishes the Clerk's Record Perpetuation Fund #502, into which will be deposited the document storage fees and facsimile transmission fees assessed and collected by the Carmel City Court. Section III: All prior Ordinances or parts thereof inconsistent with any provision of this Ordinance are hereby repealed. Section IV.' This Ordinance shall be in full force and effect from and after its passage and signing by the Mayor.
