ORDINANCE NO. D-1603-02
AN ORDINANCE OF THE COMMON COUNCIL OF
THE CITY OF CARMEL, INDIANA, CONCERNING
PARKS AND RECREATION INTERLOCAL AGREEMENT
DATED JULY 26, 2002
WHEREAS, the Common Council of the City of Carmel ("Council") has the authority to
amend the Carmel City Code; and
WHEREAS, the Council, as the f~scal body of the City of Carmel ("City") has the
responsibility, pursuant to I.C. 36-1-7-4 to approve any interlocal cooperation agreement entered
into by the City; and
WHEREAS, on July 26, 2002, the Council, the Mayor, the Clay Township Advisory
Board and the Clay Township Trustee entered into an Interlocal Cooperation Agreement
Between The City of Carmel, Indiana, and Clay Township of Hamilton County, Indiana
("Agreement"); and
WHEREAS, the Council desires to codify the Agreement and amend the Carmel City
Code to comply with the Agreement;
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of
Carmel, Indiana, as follows:
Section I: Chapter 2, Article 1, Division II, Section 2-6 of the City of Carmel,
Indiana Code of Ordinances hereby is amended by the deletion of thc
language which is stricken-through and by the addition of the language
which is underlined, to read as follows:
Sec. 2-6 Park and Recreation Board Abolished - Joint Board.
(a) The City of Carmel Board of Parks and P~ecreation is abolished and the
ordinance creating the same is repealed.
(b) The Joinder Agreement between the City of Carmel, Indiana and Clay
Township executed by the City Council on the 26th day of July, 2002 is ratified and made
a part of the City Code (by reference) pursuant to the adoption of this ordinance, effective
on the date of signing.
SectionII: Chapter 2, Article 4, Sec. 2-119 the City of Carmel, Indiana, Code of
Ordinances are hereby amended by the deletion of the language which is
stricken-through and by the addition of the language which is underlined,
to read as follows:

Sec. 2-119 Operating l~nd for the Board of Parks and Recreation.
(a) Under the provisions of the "Park and Recreation Law" there is hereby
established a special non-reverting operating fund created from moneys and fees
procured from park and recreation activities, including but not limited to swimming
pools, skating finks, fun runs, arts, and crafts.
(b) Under the provisions of the "Park and Recreation Law" expenditures may
be made from the special non-reverting operating fund by the Board upon approved
claims in the same manner as all other Board claims.
(c) The life of the operating fund shall be perpetual until terminated by
subsequent ordinance duly enacted by the governing body herein.
Section III: Chapter 2, Article 5, Section 2-131 of the City of Carmel, Indiana Code of
Ordinances hereby is amended by the deletion of the language which is
stricken-through and by the addition of the language which is underlined,
to read as follows:
Sec. 2-131 Purchasing Agencies and Purchasing Agents.
(a) Purchasing Agencies.
(1) The Board of Public Works and Safety is designated as the Purchasing
Agency for all Executive Branch departments, commissions, agencies and other
establishments of the Executive Branch, except for the Common Council, the City
of Carmel Redevelopment Commission, the Carmel-Clay Board of Parks and
Recreation, the City of Carmel Redevelopment Authority, the Carmel Economic
Development Commission, and the Carmel Civic Square Building Corporation.
(2) The Common Council is designated as the Purchasing Agency for the
Common Council.
(3) The Clerk-Treasurer is designated as the Purchasing Agency for all
Fiscal Branch departments and establishments within his/her control and authority.
(4) The City Court Judge is designated as the Purchasing Agency for all
Judicial Branch departments and establishments within his/her control and
authority.
(5) The City of Carmel Redevelopment Commission is designated as the
purchasing Agency for all activities and establishments within its control and
authority.
(6) The Carmel/Clay Board of Parks and Recreation (also known as the
Carmei-Clay Parks and Recreation Board) is designated as the purchasing Agency

for all departments, commissions, agencies and establishments within its control
and authority pursuant to the Interlocal Cooperation Agreement Between The City
of Carmel, Indiana, and Clay Township Of Hamilton County, Indiana dated July
26, 2002.
(7) The City of Carmel Redevelopment Authority is designated as the
Purchasing Agency for all activities and establishments within its control and
authority.
(8) The Cannel Economic Development Commission is designated as the
Purchasing Agency for all activities and establishments within its control and
authority.
(9) The Cannel Civic Square Building Corporation is designated as the
Purchasing Agency for all activities and establishments within its control and
authority.
(b) Each purchasing Agency shall have all the powers and duties authorized a
Purchasing Agency under I.C. 5-22.
(c) Each Purchasing Agency may designate, in writing, department head and
other appropriate officials as purchasing agents.
(d) purchasing agents shall be designated by job title and not by individual
naltle.
(e) Each purchasing Agency may grant its purchasing agents the authority to
designate an appropriate number of deputy purchasing agents for their respective
departments or functional units.
(f) A list of all purchasing agents and deputy purchasing agents for each
department or functional unit shall be maintained and updated as needed by each
Purchasing Agency and a copy of each such list shall be provided to and maintained in
the Clerk-Treasurer's Office.
Section IV: Chapter 5, Article 2 of the City of Carmel, Indiana Code of Ordinances
hereby is amended by the deletion of the language which is stricken-
through and by the addition of the language which is underlined, to read as
follows:
ARTICLE 2. DEPARTMENT AND BOARD ESTABLISHED.

Sec. 5-10 Parks and Recreation Board.
The Parks and Recreation Board established in Section 2-6 of this Code shall
consist of eleven (11) members appointed in conformance with the Interlocal
Cooperation Agreement Between The City of Carmel, Indiana And Clay Township Of
Hamilton County, Indiana dated July 26, 2001.
Section V: All prior ordinances or parts thereof inconsistent with any provision of this
Ordinance are hereby repealed.
Section VI: This Ordinance shall be in full force and effect from and after its passage
and signing by the Mayor.
