ORDINANCE NO. D-1569-02
AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA,
AMENDING CHAPTER 2, ARTICLE 4, SECTION 2-96
OF THE CARMEL CITY CODE
WHEREAS, Carmel City Code Section 2-96 establishes the City's Paramedic, Emergency
Ambulance and Fire Service Capital Fund and establishes the fees to be charged to those who benefit from
the City's basic and advanced life support services; and
WHEREAS, the life support service fees set forth in Carmel City Code Section 2-96 are outdated,
do not reflect current Federal regulatory fee allowances and should now be amended to serve the best
interests of the City and its residents and
WHEREAS, in anticipation of the need to make future life support service fees changes to reflect
changes in Medicare and similar health care regulations, the Common Council believes that, in such
circumstances only, it is more expedient and efficient to permit the Carmel Fire Chief to adjust the City's
future life support service fees than to require such fee charges to be changed by separate ordinance.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel,
Indiana, as follows:
Section 1: The foregoing Recitals are fully incorporated herein by this reference.
.Section 2: That Chapter 2, Article 4, Section 2-96 of the Carmel City Code should be and the
same is hereby amended and shall read as follows:
"Sec. 2-96.
(i) The Carmel Fire Department is authorized to provide emergency medical
services and charge fees to citizens who benefit from said services in the amount
of $260.00 for basic life support service, $310.00 for advanced life support I,
$450.00 for advanced life support II and $525.00 for specialty case transport, as
well as $6.00 per loaded mile, within the terms and meanings of the Indiana
Emergency Medical Act and other applicable law.

In the event changes in Medicare or other federal or state health care
regulations require or allow an adjustment to the current charges set forth
hereinabove, the Carmel Fire Chief is authorized to adjust same, such
adjustments to take effect on the calendar date immediately following the
date on which written notice of said adjustments is hand-delivered or
mailed by the Fire Chief by U.S. Certified mail, return receipt requested, to
the Mayor, Clerk-Treasurer, Common Council President and City Attorney.

Section 3. That the remaining provisions of Carmel City Code Section 2-96 are not affected by
this Ordinance and remain in full force and effect.
Section 4. If any portion of this Ordinance is for any reason declared to be unconstitutional or
invalid, such decision shall not affect the validity of the remaining portions of this Ordinance so long as
enforcement of same can be given the same effect.
Section 5. This Ordinance shall be in full force and effect from and after its passage and signing
by the Mayor.
