AN ORDINANCE CREATING A CARMEL CABLE TELEVISION
ADVISORY COMMITTEE TO THE COMMON COUNCIL OF THE
CITY OF CARMEL, INDIANA.
WHEREAS the City of Carmel, Indiana has granted a franchise
to Hamilton County CATV, Inc. for 25 years to provide a community
antenna cable television system for the citizens of Carmel,
and has provided to Hamilton County CATV, Inc. rightS to
use public easements for the purpose of installing said system,
and,
WHEREAS, such franchise agreement provides for local
community programming, for basic fees charged for installation
and services, for expansion of the system to newly annexed
areas, and for high quality service to customers within the
city, and
WHEREAS, the Common Council of the City of Carmel, Indiana
has an obligation to enforce the provisions of said franchise
agreement and thus deems it adviseable to have an advisory
committee of Carmel citizens assist the Council in monitoring
the services provided by Hamilton County CATV, Inc., and the
provisions of the franchise agreement,
NOW THEREFORE BE IT ORDAINE~ by the Common Council of the
city of Carmel, Indiana that a special committee be formed of
residents of the city of Carmel, said committee to be known as
the Carmel Cable Television Advisory Committee, and that this
committee be composed of five voting members who shall serve
terms of two years beginning April 1, 1981, and that said terms
shall be stagga~d with the first appointees serving until a
year specified herein, and that appointment to this committee
and the first expiration year of each appointee's first term
shall be in a manner as ~escribed below:
One member appointed by the Mayor of Carmel (term to
first expire in 1982);
One member appointed by the Common Council who shall
be a member of the Council (term to first expire
in 1982);
One member appointed by the Carmel Library Board (term
to first expire in 1983);
One member appointed by the Board of Trustees of Carmel
Clay Schools (term to first expire in 1983);
One member appointed by the Board of Directors of the
Carmel Clay Chamber of Commerce (term to first
expire in 1983); and
BE IT FURTHER ORDAINED that Hamilton County CATV, Inc.
shall appoint a representative to serve as an ex officio member
of the committee and that this committee shall designate its
own officers and organize itself in such a way that allows it
to meet not less than once per quart~in order to review the
operations of the franchise holder, to seek resolution of com-
plaints made by citizens of Carmel with regard to the operations
of the franchise, to recommend to the Common Council any rate
'~~ provided by the franchise agreement, and in all other
ways necessary provide community liason with Hamilton County
CATV, Inc., providing nothing stated in this ordinance shall
of the responsibilities of the ~mmon Council, the

Mayor or the main fiduciary agent of the City of Carmel as
set forth in the franchise agreement with Hamilton County CATV,
Inc., the constitution and statu~es of the State of Indiana
or the ordinances of the City of Carmel, Indiana.
This ordinance shall be in full force and effect upon
