AN ORDINANCE OF THE CITY OF CARMEL, INDIANA, APPROVING
THE CARMEL CIVIC SQUARE BUILDING CORPORATION AND OTHER
MATTERS RELATED THERETO
WHEREAS, the Petition of fifty (50) or more taxpaying citi-
zens of the City of Carmel, Indiana, has heretofore been filed
requesting the obtaining of construction, installation and
related improvements, of the master fire station and City Civic
Square, together with the securing of a lease for such project;
and
WHEREAS, the Carmel Civic Square Building Corporation has
been duly organized pursuant to the provisions of the Indiana
Not-for-Profit Corporation Act for the purpose of erecting and
leasing, among other purposes, a master fire station for use by
the City of Carmel, Indiana; and
WHEREAS, drawings, plans, specifications and estimates
have been submitted to all appropriate agencies as required by
law, the same having been submitted to and now meet with the
approval of this Council; and
WHEREAS, bids have been submitted, pursuant to appropriate
statute, for the construction of said project, and a tentative
award of said contract having been made subject to certain con-
ditions, including successful financing; and
WHEREAS, it appears to the Council that said drawings,
plans, specifications and estimates provide the necessary facil-
ities for the City and citizens of Carmel, Indiana;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF
THE CITY OF CARMEL, INDIANA:
Section 1. That it is hereby determined to be proper and
in the public interest to approve the incorporation of the cor-
poration known and designated as the Carmel Civic Square Build-
ing Corporation for the purpose of financing, constructing and
equipping certain fire headquarters facilities and leasing same
to the City.
Section 2. That the Articles of Incorporation and By-Laws
of the Carmel Civic Square Building Corporation, presented to
and now before this Common Council, are hereby approved.
Section 3. That the providing for the financing, construct-
ing and equipping of such facilities by the Carmel Civic Square
Building Corporation and the leasing of same to the City
through the Board of Public Works and Safety is in the public
interest of the citizens of the City, and it is a proper public
purpose for which this Common Council agrees to cooperate with
the Carmel Civic Square Building Corporation and to assist it
in fulfilling the requirements of all agencies of the Federal,
State and City governments.
Section 4. That the Common Council approves the appoint-
ment of the directors of said Not-for-Profit Corporation, the
same being: Messrs. John D. Proffitt, Kenneth M. Keltner,
Daniel O'Malia, C. Evan Parks and William A. York, Ph.D.
Section 5.. That legal counsel is instructed to prepare
and submit to the Common Council for its approval a proposed
lease agreement with the Carmel Civic Square Building Corpora-
tion, which lease shall provide for a fair and reasonable
rental.
Section 6. This ordinance shall be in full force and
effect from and after its passage and signing by the Mayor.
