D-500 Amend Weight LimitsORDINANCE D ~ AN ORDINANCE AMENDING THE CARMEL CITY CODE 41.21 WEIGHT LIMITS WHEREAS, the City of Carmel, Indiana, has enacted and codified an Ordinance regulating the weight limits of motor vehicles on city streets, at City Code §41.21; and WHEREAS, it is necessary that said ordinance be amended, and it is in the best interest of the citizens of the City of Carmel, Indiana, that the Ordinance be amended; Now, therefore, be it ordained by the Common Council of the City of Carmel, Indiana, that the City Code §41.21 Weight Limits, shall be amended to read as follows: (a) No person shall drive any vehicle on a residential street if that vehicle has gross weight of more than five thousand (5,000) pounds. (b) Subsection (a) shall not apply to vehicles under the following circumstances: vehicle; 2. 3. visiting guest; Any public or private emergency or medical services Regular trash removal and pickup service vehicle; Recreational vehicles owned by Carmel residents or 4. Vehicles used for the delivery of consumer goods customers by wholesale or retail vendors; to 5. Moving vans engaged in removing or delivering residen- tial or business property; 6. Construction vehicles which are entering or leaving a construction site which cannot reasonably be accessed by another route; 7. School buses titled to a municipal entity and used to transport school children to and from school and to and from athletic games, events or school functions, but not including privately owned vehicles with the capacity of 5 passengers or less; 8. Any vehicle(s) for which permission is granted by the Carmel Board of Public Works and Safty to use residential streets or establish a service route on residential streets. However, in any such case, such vehicles shall travel over the shortest possible route upon said street from the point of entry and shall leave the same at the nearest available point of exit. (c) A residential street for purposes of this section shall mean any roadway within the City limits which is primarily used to provide circulation of vehicular traffic within neighborhood areas, or to provide convenient means of ingress and egress for vehicular traffic to reach main aterioral streets, state and federal highways. That an emergency exists and this amendment shall be effec- tive upon passage. Ail of which is ordained and enacted this 27th day of October, 1986. Now therefore be it ordained by the Board of Trustees of the Town o.f. Carmel, Indiana. Section 1. That any motor vehicle having a gross weigJat in excess of five (5) tons shell not use the streets of the ~own of Cermsl during the months of February, March and April. Sedton 2. The penalty for violation of this ordinance shall be ten dollers ($10.O0) for any one offense.
