D-1617-03 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, AMENDING CHAPTER 8, ARTICLE 4, SECTION 8-34 OF THE CARMEL CITY CODE WHEREAS, the Common Council of the City of Carmel, Indiana, may determine the location of curb loading zones within the City's corporate limits; and WHEREAS, the creation of a curb loading zone for school busses servicing the Carmel-Clay High School is in the best interests and protects the safety and welfare of the public. NOW, THEREFORE, BE IT ORDAINED, by the Common Council of the City of Carmel, Indiana, as follows: Section 1. The foregoing Recitals are fully incorporated herein by this reference. Section 2. The following paragraphs should be and the same is hereby added to Carmel City Code Chapter 8, Article 4, Section 8,34 and shall read as follows: "Sec. 8-34(c) (c) A twenty (20) minute School Bus Loading Zone for the exclusive use of Carmel-Clay Schools busses then engaged in the loading or unloading of Carmel-Clay Schools students, faculty, employees and/or authorized visitors or guests, is hereby established at the following locations and for the following time periods: (1) On and about the curb located on the north side of Main Street (131st Street) beginning at that point which is two hundred sixty feet (260') east of the east side of 4m Avenue North East as it intersects with Main Street and running eastward along said curb for three hundred feet (300'). This curb loading zone shall be in effect from 3:00 p.m. to 3:20 p.m. on Monday through Friday each week of the year. (2) Reserved. (3) Reserved. (d) The Carmel Street Department shall post appropriate signs and/or markings at the location(s) set forth in sub-section (c) above, designating same as a "School Bus Loading Zone." (e) It shall be unlawful for any person to cause or permit any vehicle, other than an authorized vehicle to park, stand or drive in, on or within any portion of any curb loading zone, or to otherwise obstruct the use thereof by authorized vehicles. (f) Any person who violates this Section shall be subject to a fine not to exceed $1,000 per violation. Each day shall constitute a separate violation. Page One of Three Pages Prepared by Douglas C. Haney, Carmel City Attorney SPONb,~R(S): Councilor Battreall (g) In addition to any other penalties set forth hereinabove or as otherwise permitted by law, any vehicle located in, on or within a Loading Zone, or obstructing access to same, in violation of this Section, may be removed at the order of a sworn law enforcement officer at the sole cost and expense of said vehicle's owner." The remaining portions of City Code Chapter 8, Article 4, Section 8-34 are not affected by this Ordinance and shall remain in full force and effect. Section 3. All City ordinances or parts thereof inconsistent with any provision of this Ordinance are hereby repealed, to the extent of such inconsistency only, as of the effective date of this Ordinance. However, the repeal or amendment by this Ordinance of any other ordinance does not affect any rights or liabilities accrued, penalties incurred or proceedings begun prior to the effective date of this Ordinance. Those rights, liabilities and proceedings are continued and penalties shall be imposed and enforced under such repealed or amended ordinance as if this Ordinance had not been adopted. Section 4. This Ordinance shall be in full force"and effect from and after the latter of (i) its passage, signing by the Mayor and such publication as is required by law, or (ii) the date on which sign(s) giving notice of the traffic regulations referenced herein are posted at the location affected thereby. 1 9.~4q PASSED by the Common Council of the City of Carmel, Indiana, this / C) day of __ z7~,~5 '5 T~ ~' nays.
