ORDINANCE NO. D-1658-03
AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL~ INDIANA,
ESTABLISHING THE CARMEL HOUSING AUTHORITY FUND
WHEREAS, the Common Council of the City of Carmel, Indiana, adopted Ordinance D-1442-
99, which established the Carmel Housing Authority, on November 1, 1999; and
WHEREAS, the Clerk-Treasurer, as the fiscal officer for the City of Carmel, has
determined there is a need to establish a separate fund for the collection and expenditure of funds by
the Carmel Housing Authority
NOW, THEREFORE, BE IT ORDAINED, by the Common Council of the City of Carmel,
Indiana, as follows:
Section 1. The foregoing Recitals are fully incorporated herein by this reference.
Section 2. Chapter 2, Article 4, of the Carmel City Code is hereby amended to include new
Code Section 2-125, which shall read as follows:
"Sec. 2-125. Carmel Housing Authority Fund (Fund 904).
a) There is established a Carmel Housing Authority Fund.

The Carmel Housing Authority Fund shall consist only of monies received by
the Carmel Housing Authority, plus all investment earnings thereon.
The Carmel Housing Authority Fund shall be funded by any means and used
for any purpose authorized by applicable law, with all monies therein being
properly receipted and disbursed.
d)
The Carmel Housing Authority Fund shall be administered by the fiscal officer
of the City."
Section 3. The remaining provisions of City Code Chapter 2, Article 4, are not affected by this
Ordinance and remain in full force and effect.
Section 4. Should any provision or portion of this Ordinance be declared by a court of
competent jurisdiction to be invalid for any reason, the remaining provisions shall not be affected so
long as they can, without the invalid provision, be given the effect intended by the Common Council in
adopting this Ordinance. To this end, the provisions of this Ordinance are severable.
Section 5. This Ordinance shall become be in full force and effect from and after its passage,
signing by the Mayor and such publication as is required by law.
