ORDINANCE NO. D-1647-03
AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA~
AMENDING CHAPTER 10~ ARTICLE 4, DIVISION III, SECTION 10-227(a),
OF THE CARMEL CITY CODE
WHEREAS, pursuant to Carmel City Code Section 10-227(a), the Mayor has the authority to
permit banners to be temporarily displayed in the City for civic events; and
WHEREAS, the proliferation of civic event banners erected at the comers of 116th Street and
Keystone Avenue and 126th Street and Keystone Avenue has caused those locations to become unsightly
and disruptive to the normal and safe flow of traffic; and
WHEREAS, it is in the best interests of public safety and welfare to prohibit civic event banners
at the comers of those locations.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel,
Indiana, that:
Section 1. The foregoing Recitals are fully incorporated herein by this reference.
Section 2. Chapter 10, Article 4, Division III, Section 10-227(a) of the Carmel City Code is
hereby amended and, as amended, shall read as follows:
"Sec. 10-227.
(a) Street banners for civic events. A banner for special events designated by the Mayor
of the City may be erected no more than thirty (30) days prior to the event and shall be removed
no more than three (3) days after the event. The erection of a banner for a special event is
further subject to the approval of the appropriate governmental agency having jurisdiction over
the proposed location of the banner. Notwithstanding the above, no civic event banners shall be
erected or maintained at the corners of 116th Street and Keystone Avenue or the corners of 126th
Street and Keystone Avenue in the City."
Section 3. The remaining provisions of Carmel City Code Chapter 10, Article 4, Division III,
Section 10-227, are not affected by this Ordinance and shall remain in full force and effect.
Section 4. All City ordinances or parts thereof inconsistent with any provision of this Ordinance
are hereby repealed, to the extent of such inconsistency only, as of the effective date of this Ordinance.
However, the repeal or amendment by this Ordinance of any other ordinance does not affect any rights or
liabilities accrued, penalties incurred or proceedings begun prior to the effective date of this Ordinance.
Those rights, liabilities and proceedings are continued and penalties shall be imposed and enforced under
such repealed or amended ordinance as if this Ordinance had not been adopted.

Section 5. All prior ordinances or parts thereof inconsistent with any provision of this Ordinance
are hereby repealed as of the effective date of this Ordinance.
Section 6. This Ordinance shall be in full force and effect from and after its passage, signing by
the Mayor and such publication as is required by law.
