COUNCIL CHAMBERS/CITY HALL/ONE CIVIC SQUARE MEETING CALLED TO ORDER Council President Sue Finkam (via Microsoft Teams); Council Members: Laura Campbell, Kevin D. Rider, Adam Aasen, Tim Hannon, Anthony Green, Miles Nelson, Jeff Worrell and Deputy Clerk Jacob Quinn were present. Councilor H. Bruce Kimball was not present. Council President Finkam called the meeting to order at 6:00 p.m. AGENDA APPROVAL The agenda was approved unanimously. INVOCATION Pastor Brian Baker, Northview Church, delivered the Invocation. Councilor Rider led the Pledge of Allegiance. RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS There were none. RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL There were none. COUNCIL AND MAYORAL COMMENTS/OBSERVATIONS There were none. CONSENT AGENDA Councilor Rider moved to approve the consent agenda. Councilor Worrell seconded. There was no Council discussion. Council President Finkam called for the vote. The motion was approved 8-0. a. Approval of Minutes 1. September 20, 2021 Regular Meeting 2. COMMITTEE REPORTS Councilor Worrell reported that the Finance, Utilities and Rules Committee did meet and is returning five items to Council. Councilor Rider reported that the Land Use and Special Studies Committee had not met. Councilor Hannon presented that a Committee of the Whole met to discuss a personnel issue and make recommendations. He stated that the work is still in process and the committee will meet again. OTHER REPORTS – (at the first meeting of the month specified below): Henry Mestetsky, Redevelopment Director, gave the monthly Redevelopment Commission report. Henry Mestetsky gave the bi-annual Redevelopment Authority Report. Joshua Biggs gave the quarterly report for the Carmel Historic Preservation Commission. The written report for the Audit Committee was included in the Council packet. Jeff McDermott, President & CEO of the Center for the Performing Arts, gave an update to Council. Adrienne Keeling, Department of Community Services, presented on the Comprehenvie Plan for the City of Carmel. OLD BUSINESS Council President Finkam announced the Second Reading of Ordinance D-2596-21; An Ordinance of the Common Council of the City of Carmel, Indiana, Authorizing the Issuance of Economic Development Tax Increment Revenue Bonds to Support the Hamilton Crossing Development Project, and Authorizing and Approving Other Actions in Respect Thereto. Councilor Worrell announced that the item is returning from the Finance, Utilities and Rules Committee with a positive 4-0 recommendation. Bruce Donaldson, Barnes and Thornburg, addressed Council. Henry Mestetsky addressed Council. Councilor Worrell moved to approve Ordinance D-2596-21. Councilor Aasen seconded. There was no Council discussion. Council President Finkam called for the vote. Ordinance D-2596-21 was approved 8-0. Council President Finkam announced the Second Reading of Ordinance D-2595-21; An Ordinance of the Common Council of the City of Carmel, Indiana, Establishing the Appropriations for the 2022 Budget. There was extensive Council discussion. Councilor Worrell moved to amend Ordinance D-2595- 21 by reducing the Support for the Arts line item (1160-4355101) to $1,883,554.50. Councilor Rider seconded. There was extensive Council discussion. Council President Finkam called for the vote. The motion failed (Campbell, Green, Hannon, and Finkam opposed). Councilor Rider moved to amend DocuSign Envelope ID: 1A4044CA-5355-4B57-A655-F0200AD4E8C8 3 Ordinance D-2595-21 by reducing the Support for the Arts line item (1160-4355101) to $1,183,554.50. Councilor Hannon seconded. There was extensive Council discussion. Council President Finkam passed the gavel to Councilor Rider and addressed Council. Councilor Rider called for the vote. The motion to amend was approved 8-0. Council President Finkam regained the gavel. Councilor Rider moved to amend the Festival/Community Events line item (1110-4359003) by increasing it to $60,000. Councilor Aasen seconded. There was brief Council discussion. Council President Finkam called for the vote. The motion to amend was approved 8-0. Mayor Brainard stated that he was in favor of the increase. Councilor Rider moved to approve Ordinance D-2595-21 As Amended. Councilor Nelson seconded. There was no Council discussion. Council President Finkam called for the vote. Ordinance D-2595-21 As Amended was approved 8-0 Council President Finkam announced the Second Reading of Ordinance D-2591-21; An Ordinance of the Common Council of the City of Carmel, Indiana, Fixing Salaries of Appointed Officers and Employees of the Carmel City Clerk for the Year 2022. Councilor Worrell announced that the item is returning from the Finance, Utilities and Rules Committee with a positive 4-0 recommendation. Councilor Rider moved to approve Ordinance D-2591-21. Councilor Nelson seconded. There was no Council discussion. Council President Finkam called for the vote. Ordinance D-2591-21 was approved 8-0. Council President Finkam announced the Second Reading of Ordinance D-2592-21; An Ordinance of the Common Council of the City of Carmel, Indiana, Fixing Salaries of Appointed Officers and Employees of the Carmel City Court for the Year 2022. Councilor Worrell announced that the item is returning from the Finance, Utilities and Rules Committee with a positive 4-0 recommendation. Councilor Worrell moved to approve Ordinance D-2592-21. Councilor Rider seconded. There was no Council discussion. Council President Finkam called for the vote. Ordinance D-2591-21 was approved 8-0. Council President Finkam announced the Second Reading of Ordinance D-2593-21; An Ordinance of the Common Council of the City of Carmel, Indiana, Fixing Salaries of Appointed Officers and Employees of the City of Carmel, Indiana, for the Year 2022. Councilor Worrell announced that the item is returning from the Finance, Utilities and Rules Committee with a positive 4-0 recommendation. Jon Oberlander, Interim Corporation Counsel, presented to Council. Councilor Green moved to amend Ordinance D-2593-21 by inserting Version A in whole. Councilor Aasen seconded. There was no Council discussion. Council President Finkam called for the vote. The motion to amend was approved 8-0. Councilor Campbell moved to approve Ordinance D-2593-21 As Amended. PUBLIC HEARINGS Council President Finkam announced the First Reading of Ordinance D-2597-21; An Ordinance of the Common Council of the City of Carmel, Indiana, Authorizing and Approving an Appropriation of Funds from the ARP Coronavirus Local Fiscal Recovery Fund (Fund #176). NEW BUSINESS Council President Finkam announced Resolution CC-10-04-21-02: A Resolution of the Common Council of the City of Carmel, Indiana, to Limit the Rate for Taxes Payable in 2022 and Authorize Necessary Temporary Borrowing Among City Funds. Councilor Worrell moved to introduce the item into business. Councilor Rider seconded. Mayor Brainard presented the item to Council. Curt Coonrod, C.L. Coonrod & Co., addressed Council questions. Councilor Rider moved to approve Resolution CC-10-04- 21-02. Councilor Aasen seconded. There was no Council discussion. Council President Finkam called for the vote. Council President Finkam announced the First Reading of Ordinance D-2599-21; An Ordinance of the Common Council of the City of Carmel, Indiana, Amending the 2021 Salary Ordinance. Councilor Worrell moved to introduce the item into business. Councilor Rider seconded. Jon Oberlander presented the item to Council. Councilor Worrell moved to introduce the item into business. Councilor Rider seconded. Councilor Worrell moved to approve Resolution CC-10-04-21-01. Councilor Rider seconded.
