ORDINANCE NO. D-1618-03
AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA,
ADOPTING AND ADDING CHAPTER 8, ARTICLE 5, SECTION 8-70
TO THE CARMEL CITY CODE
WHEREAS, the Common Council of the City of Carmel has the authority to adopt traffic,
public health and safety regulations; and,
WHEREAS, dirt, dust, leaves and litter escaping from vehicles traveling on City streets and
City rights of way create maintenance, health and safety issues for the City and the public at large; and,
WHEREAS, limiting the escape of such objects from vehicles traveling on City streets and City
rights of way is in the public interest.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel,
Indiana, as follows:
Section I. The foregoing Recitals are incorporated herein by thi~ reference.
Section 2. Chapter 8, Article 7, Section 8-70 is hereby adopted and added to the Carmel City
Code and shall be read as follows:
"Sec. 8-70. VEHICLES TO BE COVERED.
a) It shall be unlawful for any vehicle to haul or carry any kind of dirt, rubbish, waste, debris, or any other
contents, whether liquid or solid, unless such vehicle is covered to prevent any part of its load from
spilling, blowing, dropping, or otherwise escaping from the vehicle onto any City street, City right-of-way
or other public place within the City's corporate limits, provided, however, that these requirements shall
not apply to vehicles hauling or carrying brush cuttings, tree trimmings, branches, or logs, if such material
is securely lashed to the vehicle to prevent any part of the load from spilling, blowing, dropping or
otherwise escaping from the vehicle, and provided further that these requirements shall not apply to
vehicles when they are engaged in snow removal services.
b) For purposes of this Section, a "vehicle" is defined as any motorized or self-propelled automobile,
truck, van or other similar machine or equipment, as well as any trailer, wagon, cart or other wheeled or
tracked unit being pushed or pulled by a motorized or self-propelled machine or equipment
c) Anyone violating this Section shall be fined not less than Fifty Dollars ($50.00) nor more than Five
Hundred Dollars ($500.00) for each offense, a separate offense being deemed committed on each day
during or on which a violation occurs or continues."
Section 3. All prior ordinances or parts thereof inconsistent with any provIsIon of this
Ordinance are hereby repealed.

Section 4. This Ordinance shall be in full force and effect from and after the date of its passage,
signing by the Mayor and such publication as is required by law.
