CARMEL BOARD OF ZONING APPEALS | HEARING OFFICER MEETING
DEPARTMENT REPORT
MONDAY, NOVEMBER 22, 2021
(V) Buck Fence Height Variance.
The applicant seeks the following development standards variance approval:
2. Docket No. PZ-2021-00182 V UDO section 5.09.B.4 Max. 42” front yard fence height
allowed, 60” requested. The site is located at 14223 Avian Way (Avian Glen Subdivision Lot 108). It is
zoned S1/Residence. Filed by Daryl Buck, owner.
General Info & Analysis:
The Petitioner lives on a corner lot with two front yards, since it has two street frontages. Fences in the front
yard cannot exceed 42 inches in height. The Petitioner proposes a fence that is 60 inches tall. Please see the
Petitioner’s info packet for more detail on the variance request.
The fence will be an ornamental metal fence that is see through and not a privacy fence that would be opaque.
The fence will not be place right up to the sidewalk; it will be located several feet back from the street and from
the sidewalk. (Petitioner, how many feet from the sidewalk will the fence be?)
The Petitioner also has approval from the HOA (Homeowners Association).
The Petitioner addressed all but a few planning/zoning review comments, listed below. The Planning Dept.
supports the variance request, as long as the remaining review comments are addressed
a) Please provide the filled out & notarized Placement of Public Notice Sign Placement Affidavit form
(found in application) once the sign is placed.
b) Please provide the filled out & notarized Petitioner’s Affidavit of Notice of Public Hearing form (found
in application).
c) How far back from the sidewalk will the fence be?
d) Please fill out and submit the Findings of Fact sheet prior to the BZA meeting.

Recommendation:
The Dept. of Community Services (DOCS) recommends positive consideration of Docket No. PZ-2021-00182
V, and with adoption of the findings of fact submitted by the Petitioner.
