CARMEL BOARD OF ZONING APPEALS | HEARING OFFICER MEETING
DEPARTMENT REPORT
MONDAY, NOVEMBER 22, 2021
(V) Rust Lot Cover Variance.
The applicant seeks the following development standards variance approval:
3. Docket No. PZ-2021-00188 V UDO Section 2.10 Maximum 35% lot cover allowed, 42%
requested. The site is located at 842 Auman Dr. W. (in Auman’s Addition Lot 13). It is zoned
R2/Residence. Filed by Brandon and Lindsay Rust, owners.
General Info & Analysis:
The Petitioner seeks approval to exceed the allowed lot coverage. Proposed improvements to the site are
landscaping, privacy fence, swimming pool and concrete patio/pool deck, as well as a concrete walkway. The
allowed maximum lot coverage is 35%, and the proposed lot cover is 42%. This is a 7% increase. Please see
the Petitioner’s info packet for more detail on the variance request.
There is not a Homeowners Association for Auman’s Addition.
The pool pump equipment will be located approximately 10-12 feet from the north/side property line. (The
product brochure for the pool equipment should show that it will be a quiet model that will reduce/muffle
noise/vibrations. Petitioner, please provide this info.)
The Petitioner continues to work with the Carmel Engineering Dept. and will contribute monies to the
stormwater fund, in lieu of providing onsite stormwater detention.
The Petitioner addressed all but one planning/zoning review comments, asking about the pool pump
equipment design details. The Planning Dept. supports the variance request, as long as that comment is
addressed.

Recommendation:
The Dept. of Community Services (DOCS) recommends positive consideration of Docket No. PZ-2021-00188
V, and with adoption of the findings of fact submitted by the Petitioner.
