CARMEL BOARD OF ZONING APPEALS
DEPARTMENT REPORT
MONDAY, NOVEMBER 22, 2021
(SUA) Faith Apostolic Church Expansion.
The applicant seeks the following special use amendment approval for a building addition and site
improvements:
2. Docket No. PZ-2021-00175 SUA UDO Section 2.07 Institutional Special Use for
Church/Temple/Place of Worship. The site is located at 1212 E. 116th St. It is zoned R1/Residence
and SFHA/Special Flood Hazard Area. Filed by Jim Shinaver of Nelson & Frankenberger LLC on behalf
of Faith Apostolic Church.
General Info & Analysis:
The Petitioner seeks special use amendment approval for a building addition and site improvements which
include a parking lot, landscaping, and stormwater detention area. The proposed building materials and colors
will completement the existing building. The parking lot will be buffered and landscaped, and lighting will be
provided. No new signage is proposed at this time.
The church is located on the north side of 116th Street, two properties east of the Monon Trail. Residential uses
surround the subject site. Engledow Landscaping company is located north of the site, across the Monon Trail.
The special use amendment review is required because the church is expanding its prior-approved floor area by
more than 10%. Please see the Petitioner’s info packet for more details on the special use amendment
request.
Prior, recent development standards variances were approved on August 23, 2021 for building height and for
front building setback, with docket numbers PZ-2021-00129 V and PZ-2021-00130 V.
A future BZA variance might be needed/requested from the Carmel Flood Hazard Areas Ordinance. For now,
the Petitioner will process a floodplain reclamation analysis and report and application with the appropriate
hydraulic models. This will be submitted to the City, County and IDNR for review.
The Technical Advisory Committee (TAC) reviewed the proposal, and this special use amendment item was on
their October 20, 2021 meeting agenda. Technical aspects of the project are reviewed by TAC, and aesthetic
aspects are also reviewed, such as landscaping, lighting, drainage, and architecture. TAC members include
representatives from all City and the County agencies, as well as utility company representatives, such as from
the gas, water, and electric companies.
The Unified Development Ordinance directs the BZA to generally consider Special Use petitions favorably.
The checklist of items to review for a special use request have been checked off. The Petitioner addressed all
planning/zoning review comments; the Planning Dept. supports the special use amendment request, with the
condition of addressing all remaining TAC review comments. (One big item is that the Petitioner still needs
to submit a full set of civil drawings and a drainage report.)

Recommendation:
The Dept. of Community Services (DOCS) recommends positive consideration of Docket No. PZ-2021-00175
SU Amend, with the condition that the Petitioner addresses all remaining TAC review comments, as well as
with the adoption of the findings of fact submitted by the Petitioner.
