Approp./City Attorney Fees AN ORDINANCE CONCERNING THE PAYMENT OF ADDITIONAL ATTORNEY'S FEES FOR NON-GOVERNMENTAL SERVICES RENDERED AND TO BE RENDERED BY THE CITY ATTORNEY FOR THE CITY OF CARMEL, INDIANA BE IT ORDAINED by the Common Council for the City Indiana: Section 1 That the following agreement for additional entered into by and between the City of Carmel, City Attorney, Stephen K. Andrews, fled: This Agreement, of Carmel, attorneys' fees Indiana, and is hereby adopted and rati- entered into by and between the City of Carmel, Indiana (hereinafter referred to as the "City") and Stephen K. Andrews, Attorney at Law, 2506 Willowbrook Parkway, Suite #312, Indianapolis, as the "Attorney"), Indiana 46205 (hereinafter referred to WITNESSETH: WHEREAS, the Attorney is employed by the City to advise and represent the City in ordinary and usual matters arising out of the governmental operations of the City; and WHEREAS, the City proposes to construct a city complex requiring the issuance of general obligation bonds, revenue bonds, and/or the organization and operation of a building corporation, for said city complex; and WHEREAS, the Attorney has performed extra and unusual ser- vices for the City in regard to the aforementioned project; and WHEREAS, the Attorney is expected by the City to continue such pursuits and endeavors, together with other necessary non- governmental services to be performed until the bonds have been issued and/or building corporation organized and funded; and WHEREAS, it is determined that all of these services are other than governmental; NOW, THEREFORE, IT IS MUTUALLY AGREED BY the City and the Attorney, acting by and through its Common Council and Mayor, sitting also as Public Works and Safety, being the administrative bodies in control of said projects, that the Attorney shall be additionally compensated for services rendered and to be rendered provided herein, and that the compensation to be paid from the proceeds of said bonds, grants, building corporation, and all related financial vehicles, shall be an amount equal to Two Percent (2%) of the general obligation bonds, and/or revenue bonds, and/or building corporation funding, required to be issued for said project by the City. Said fees shall be due and payable upon receipt by the City of the proceeds from the sale of said bonds, grants, or funding of the building corporation per the is attached hereto and made a part hereof as Contract which Exhibit "A". , ~ayor~ ' --2-- ATTEST: City of Carmel ACCEPTED ST~P~N K.
