D-1725-04 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL~ INDIANA~ AMENDING CHAPTER 3~ ARTICLE 1~ DIVISION II~ SECTIONS 3-21~ OF THE CARMEL CITY CODE WHEREAS, the Common Council of the City of Carmel, Indiana, has adopted by ordinance certain procedures pertaining to the introduction of ordinances and resolutions for its consideration; and WHEREAS, those procedures, to the extent they prohibit an ordinance or resolution from being introduced into business by anyone other than the sponsor of same, is overly burdensome in cases where circumstances prevent the sponsor from attending the Council meeting at which said ordinance or resolution is to be introduced, thereby unnecessarily delaying Council consideration of matters of interest to the citizens of Carmel and the public at large; and WHEREAS, it is right and appropriate to now amend these procedures to better serve the public interest. NOW, THEREFORE, BE IT ORDAINED, by the Common Council of the City of Carmel, Indiana, as follows: Section 1. The foregoing Recitals are incorporated herein by this reference. Section 2. Chapter 3, Article 1, Division II, Section 3-21 of the Carmel City Code should be and the same is hereby amended and shall read as follows: "Sec. 3.21 Introduction of Ordinance- First Reading. The "flint reading" of an ordinance shall be its introduction, whereupon a Council member shall move to introduce the same into business and another Council member shall second that motion. Following the proper introduction of an ordinance into Council business, a sponsor of that ordinance or, in the absence of a sponsor, and if agreed by a majority of the Council membem present at the meeting, any Council member, shall, at his or her option, read the entire ordinance or provide a summary description of same. No vote shall be taken on any ordinance at its "flint reading," except on motions to amend the ordinance, unless otherwise permitted by Council rules. No ordinance or resolution may be introduced into Council business without a member of Council having agreed to sponsor the same and so indicating on the Council Agenda and on the ordinance or resolution. However, notwithstanding the above, if an officer required or permitted by Indiana law to submit an item, ordinance or resolution to the Council for its consideration does not obtain a Council sponsor for same, !he Council shall accept the item, ordinance or resolution for its agenda and introduction in accordance with Indiana law. Haney, Carmel City Attorney Sponsor(s): Councilors Sharp and Griffiths Subject to subsection (b) above, no ordinance or resolution may be introduced into business for its "first reading" at a Council meeting unless a named sponsor of same is present at the meeting and introduces said ordinance or resolution into business, except that a majority of the Council members present at the meeting may vote to permit a Council member who is not a sponsor of the ordinance or resolution to introduce the same at said meeting." Section 3. All prior ordinances or parts thereof that are inconsistent with any provision of this Ordinance are hereby repealed as of the effective date of this Ordinance. Section 4. This Ordinance shall be in full force and effect from and after the date of its passage, execution by the Mayor and such publication as is required by law.
