D-1715-04 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL INDIANA ADOPTING AND ADDING CARMEL CITY CODE CHAPTER 8 ARTICLE 6 SECTION 8-58 ~CLE WEIGHT LIMITATIONS WHEREAS, the City of Carmel, Indiana, is authorized by Indiana Code 9-20-1-3 to impose , *,~ ,~i+~';~ *he Cit,,'s Jurisdiction; and limitations on the weight of vehicles that may use streets ,Gear .... --,, ~ v ~ WHEREAS, it is in the best interests of public safety and will help lessen the deterioration of a public thoroughfare for the City to now restrict the use of River Road, from its intersection with East 146th Street south to its intersection with 131 st Street, to vehicles having a total gross weight of less than sixteen thousand (l 6,000) pounds. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel, Indiana, as follows: Section 1: The foregoing Recitals are fully incorporated herein by this reference. Section 2: That Chapter 8, Article 6, Section 8-58 should be and the same is hereby added to the Carmel City Code and shall read as follows: "Sec. 8-58 Vehicle Weight Limitation on River Road. (a) No person shall operate any vehicle having a total gross vehicle weight of 16,000 pounds or more on any portion of River Road that is located between its intersection with East 146th Street south to its intersection with 131st Street. (b) This Section shall not apply to: 1) Emergency or medical services vehicles; 2) Trash service vehicles; 3) Highway construction or maintenance vehicles or machinery used by the State of Indiana, an indiana county or municipality; 4) Vehicles being used to deliver goods to customers; 5) Moving vans when engaged in transporting property; 6) Farm drainage machinery or implements of husbandry; 7) Construction vehicles entering or leaving a construction site which cannot reasonably be accessed by another route; 8) Buses no longer than 45 feet in length; Page One of Tlu'ee Pages Prepared by Douglas C. (c) Any violation of this Section shall be deemed an Ordinance Violation and any person violating any provision hereof shall be subject to a fine of up to Five Hundred Dollars ($500.00) for each offense." Section 3. The Cannel Street Department shall promptly prepare and post appropriate signage giving notic-----e of t-he weight limitation imposed by this Section. Section 4- All portions of prior City ordinances inconsistent with any provision of this Ordinance are hereby r--'-~pealed as of the effective date of this Ordinance. _Section 5. If any portion of this Ordinance is for any reason declared to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portions of this Ordinance so long as enforcement of same can be given the same effect. _Section 6. This Ordinance compliments and does not limit the ability of law enforcement officers and other authorized individuals to charge any person with the violation of any other law or ordinance. Section 7. This Ordinance shall be in full force and effect from and after its passage and signing by the Mayor. .
