D-1692-04 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, AMENDING CHAPTER 6, ARTICLE 5, DIVISION I, SECTION 6-77(1) OF THE CARMEL CITY CODE WHEREAS, refuse storage structures used to store garbage or trash pending its removal by a trash service should be closed when not in use; and WHEREAS, open refuse storage structures are "attractive nuisances," provide a location for insects, fowl and rodents to live and multiply, and constitute a public health and safety nuisance; and WHEREAS, it is in the best interests of the public to require the doors of refuse collection structures to be closed and secured except when in use. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel, Indiana, that: Section 1. The foregoing Recitals are incorporated herein by this reference. Section 2. Section 6-77(1) should be and the same is hereby added to Carmel City Code Chapter 6, Article 5, Division I, and shall read as follows: Sec. 6-77. "(I)~m~rstructure used for the collection or deposit of trash or garbage that has an open door allowing access into said structure, except when the door is open to allow the structure to be used for the deposit or removal of trash or garbage, or to allow the structure to be cleaned or repaired." Section 3. This Ordinance shall not affect any other provisions of City Code Section 6-77, all of which remain in full force and effect. Section 3. All prior ordinances or parts thereof inconsistent with any provision of this Ordinance are hereby repealed as of the effective date of this Ordinance. Section 4. This Ordinance shall be in full force and effect from and after its passage, signing by the Mayor and such publication as is required by law.
