D-1689-04 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, ADOPTING A PROMOTION FUND FOR THE DEPARTMENT OF COMMUNITY SERVICES AS CHAPTER 2, ARTICLE 4, SECTION 2-116 OF THE CARMEL CITY CODE WHEREAS, the Common Council of the City of Carmel, Indiana, has the authority to create certain City funds to be used for the purposes provided by law; and WHEREAS, the Department of Community Services wishes to have a promotion fund established for its Department and initially funded in the sum of One Thousand Dollars ($1,000.00); and WHEREAS, the Common Council hereby approves such fund establishment and funding. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel, Indiana, as follows: Section 1: The foregoing Recitals are fully incorporated herein by this reference. Section 2: That Chapter 2, Article 4, Section 2-116 is hereby approved, adopted and made a part of the Carmel City Code and shall read as follows: "Sec. 2-111. Department Of Community Services Promotional Fund. (a) There is established a Department Of Community Services Promotional Fund. (b) The Fund shall be funded by monies appropriated from the General Fund, and used for the purposes provided by applicable law, with all monies therein being properly receipted and disbursed. (c) The Fund shall be administered by the Director of the Department of Community Services. (d) The Fund shall consist of monies properly appropriated therefore and deposited therein, in an amount not to exceed $1,000 during any one calendar year. (e) The Director of the Department of Community Services shall account, by separate line item, for the receipt and disbursement of all sums to and from the Fund." Section 3. All prior City ordinances or parts thereof that are inconsistent with any provision of this Ordinance are hereby repealed as of the effective date of this Ordinance. ~ection 4. If any portion of this Ordinance is for any reason declared to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portions of this Ordinance so long as enforcement of same can be given the same effect.
