ORDINANCE NO. D-1666-04
AS AMENDED
AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA,
ADDING CHAPTER 2, ARTICLE 3, DIVISION III, SECTION 2-63
TO THE CARMEL CITY CODE
WHEREAS, the City of Carmel's elected officials are trustees of the City's funds; and
WHEREAS, no legitimate public purpose is served by allowing elected officials who have been
defeated for re-election to attend instructional or training seminars or conferences outside of the Carmel
area in the few months between their election defeat and the end of their elected term; and
WHEREAS, it is in the public interest to avoid situations where such elected officials may be
tempted to recklessly use for hotels, food and travel City funds to travel to and attend such seminars or
conferences at taxpayer expense.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel,
Indiana, that:
Section 1. The foregoing Recitals are fully incorporated herein by this reference.
Section 2. In order to prevent an abuse of City funds and the public's trust, Chapter 2, Article 3,
Division III, Section 2-63 should be and the same is hereby added to the Carmel City Code and shall read
as follows:
"Sec. 2-63. Use Of City Funds By Elected Officials For Instruction Or Training.
No elected City official who has been defeated in a primary or general election, unless
approved by a majority vote of the Common Council, shall expend any City funds to
attend any instructional or training seminar or conference outside of Marion or Hamilton
County, Indiana, such as, but not limited to, a National League of Cities or an indiana
Association of Cities and Towns conference, that is held on any date subsequent to the
date on which the election was held that resulted in such City official being defeated for
re-election."
Section 3. All prior ordinances or parts thereof inconsistent with any provision of this Ordinance
are hereby repealed as of the effective date of this Ordinance.
Section 4.. The sections, paragraphs, sentences, clauses and phrases of this Ordinance are
separable, and if any phrase, clanse, sentence, paragraph or section of this Ordinance shall be declared
unconstitutional, invalid or ~menforceable by the valid judgment or decree of a court of competent
jurisdiction, and such unconstitutionality, invalidity or unenforceability shall not affect any of the
remaining phrases, clauses, sentences, paragraphs and sections of this Ordinance.
Section 5_. This Ordinance shall be in full force and effect from and after its passage, signing by
the Ma~or and such publication as is required by law.
