ORDINANCE NO. D,1676-04
AS AMENDED
AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA,
AMENDING CHAPTER 8, ARTICLE 5, SECTION 8-46 TO THE CARMEL CITY CODE
WHEREAS, the Common Council of the City of Carmel, Indiana, is empowered to adopt
ordinances regulating vehicular parking within the City's corporate limits and protecting the health,
safety and welfare of the City's residents and guests; and
WHEREAS, the parking of motorized vehicles on residential lawns is an eyesore and is
detrimental to public health, safety and welfare.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel,
Indiana, as follows:
Section 1. The foregoing Recitals are fully incorporated herein by this reference.
Section 2. A new subsection (c) should be and the same is hereby added to Carmel City Code
Section 8-46 and shall read as follows:
Sec. 8-46. General Parking Restrictions.
"(c)(i) No person shall stand or park any Motor Vehicle on any portion of any lawn or
greenspace located within the City's corporate limits other than for the purpose of and while
such Motor Vehicle is actually being loaded, unloaded or washed.
(ii) The provisions of this subsection shall not apply to vehicles parked so as to
allow their occupants to attend a Special Event for which a proper Special Event Permit has
been obtained from the Department of Community Services, nor to vehicles driven by City
employees while parked in the course of their City employment.
(iii) For purposes of this subsection, a "Special Event" is defined as a temporary
cultural, community or entertainment event, including but not limited to, fund-raising activities
by not-for-profit organizations, walks, runs and bike events, concerts, carnivals and arts
festivals for which a Special Event Permit has been obtained."
Nothing in this Ordinance affects the remaining portions of City Code Section 8-46, which remain in
full force and effect.
Section 3. All prior City ordinances or parts thereof that are inconsistent with any provision of
this Ordinance are hereby repealed as of the effective date of this Ordinance.
Section 4. This Ordinance shall be in full force and effect from and after the date of its passage,
execution by the Mayor, and publication as required by law.
