D-1674-04 -- AS AMENDED AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, AMENDING CHAPTER 4, ARTICLE 3, DIVISION IV, SECTION 4-79, OF THE CARMEL CITY CODE WHEREAS, the occurrence of false alarms from private residential and commercial alarm systems has become an increasing problem in the City; and WHEREAS, the City's public safety personnel are put at risk and are rendered unavailable for other public safety emergencies whenever they respond to a false alarm; and WHEREAS, the Common Council desires to modify the current civil penalty schedule for false alarms in order to encourage City residents to keep their private alarm systems in good working order. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel, Indiana, as follows: Section 1.. The foregoing Recitals are fully incorporated herein by this reference. e~;ion 2. Chapter 4, Article 3, Division Pd, Section 4-79 of the Carmel City Code should be and the same is hereby amended to read as follows: "Sec. 4-79 Schedule of Code Provisions and Penalties. (a) The following code (or ordinanCe) provisions and respective civit penalties are designed for enforcement through the Carmel City Court: Code Section . · ear $400.0? I, 4-77 irt calendar ear (b) in addition to the civil penalty for a fifth or subsequent False Alarm within a calendar year, an alarm system permit may be subject to suspension or revocation pursuant to conditions and procedures established in Section 4-75(c) of this Article once the alarm system has had five (5) False Alarms within a calendar year." Section 3. All pr/or ordinances or parts thereof inconsistent with any provision of this Ordinance are here~y repealed as of the effective date of this Ordinance.
