HomeMy WebLinkAboutD-202 Twp Fire Protect Contract BE IT ORDAINED by the Common Council of the City of Carmel, to-wit: That the Common Council herewith approves the "Contract for Fire Protection" entered into between the City of Carmel and Clay Township, Hamilton County, Indiana on the 1st day of January, 1979, and which contract is attached hereto, made a part hereof and marked "Exhibit A". This Ordinance shall be after its passage. Clerk-Treasurer ~ EX.~IBIT A CONTRACT FOR FIRE PROTECTION THIS AGREEMENT entered into by and between the City of Carmel, Hamilton County, Indiana, hereinafter called "CITY" and Clay Township, Hamilton County, Indiana, hereinafter called "TOWNSHIP", as of the 1st day of January, 1979, WITNESSETH: WHEREAS, the City and tered into contracts for and WHEREAS, said City said fire protection arrangements for of one year beginning as of January 1, until December 31,1979. the Township have heretofore en- fire protection of said Township; and Township have agreed to continue the additional period 1979, and continuing NOW, THEREFORE, it is mutually agreed by and between parties hereto as follows: 1. The City agrees to furnish ~e~idents of the Township outside the the fire protection to the limits of the City. 2. Clay Township hereby agrees to leave all of its fighting equipment, trucks and accessories at the dis- fire posal of said City. 3. The City will continue to operate the three (3) stations now in use. 4. The only monetary liability of the Township to the City will be to pay the contract payments as hereinafter set forth. 5. The City agrees to maintain a minimum of twenty- eight~28)~ full time, paid firemen at all times during the continuation of this Agreement, including a full time, paid Fire Chief, five (5) of said firemen to be on duty at all times, with at least three (3) full time, paid firemen to be Contract for Fire Protection Page Two of fire and ~ith sufficient training for such members to in- ~ure that all equipment be handled with reasonable skill. 6. The City agrees to purchase all materials and sup- ~lies, to pay all compensation to regular or volunteer fire- men, pay the costs of the operation of said fire department and to carry all necessary insurance on firemen and on all equipment of the City and Township, and to save harmless from any and all liability. the Township 7. The City agrees to furnish a complete inventory of all apparatus and equipment, together with a statement as to its operating condition, quarterly by calendar quarters. The City further agrees to furnish a quarterly statement of all operating expenses. 8. For and in consideration of the promises and agree- ~ents herein, said Township does hereby agree to pay said City the total sum of Two Hundred Ninety-nine Thousand Two Hundred Sixty-five Dollars ($299,265.00) in the following manner: $150~000.00 on or before July 16, 1979; and $149,265.00 on or before December 31, 1979. 9. This Agreement shall be in full force and effect of the first day of January, 1979, and continue until the 31st day of December, 1979, unless both parties agree in writing to any change.
