BERED D-l D- 2 150 BE IT ORDAINED BY TEE COMMON cOUNCIL OF THE CITY OF CARMEL, II, DIANA, to-wit: 1. That there shall be and there is hereby established for the City of Carmel, the requirement for any person or firm wishing to make any cut into the pavement or into any other portion of any street, sidealk, ctnrb or public place, or to excavate therein, br to excavate beneath the surface for the construction, alteration or repair of any driveway, sewer, sidew, alk, or water line or other buried facility, or for the installation of any such work, to have a permit from the City of Carmel prior to beginning any such work. 2. That any person or firm perfoz~ning any work as described in Section i of this Ordinance and ptUrsuant to a permit from the City of Ca~mel, shall also ~gree to indemnify the City of Carmel and any other pa~ty interested in such work or its performance against all claims, demands, actions, judgments, losses and expenses which may arise from any injuries to person or persons or damage to any property resulting from such work, or from any conditions created by such work in the street or any public place. 3 · REQUIREEENTS JUNE M, HEDGES, RECO~'DER. HAMILTON COUNTY, a. Every applicant for a permit shall post a cash deposit of $200.00 or a bond in the amount of $2,000.00 with the City Clerk-Treasurer and which cash or bond will remain with the City of Carmel until the completion and acceptance of the work performed. b. In the event that a cut in a street runs lengthwise on such street, the applicant wishing to proceed with such work shall be required to post a bond on the basis of $5.00 per lineal foot; provided however that said bond shall be in an amount of not less than $2,000.00. ,, 150 597 c. Said cash deposit sh~l be returned and/or ~e bond cancelled only ~ter the completion of the work Md inspection and ~proval by the City Engineer. Such approval sh~ll be based on the req~rement that the public proper~ disturbed be replaced in as ~od or better condition than was its con~tion prior to ~e be~nningof said work, and upon ~e further re~ir~ent that the work~shzllbe in co~ormancewith the stated conditio~ of the work permit. In the event that the public property h~s not been restored to a condition as ~od or better than it had existed prior to the be~nni~ of the work, ~e City of Carmel m~y keep sufficient of the cash deposit to perform~e necessary repOts or may call upon ~e bon~ company to perfo~ such work. ~. ~e followi~ public utilities shall not be required to post bond or other surety pursuant to this Ordinance, provided however, that such public utilities shall be req~red to notify the Ci~ Engineer of the City of Carmel prior to m~inganystreet or curb cut, and further that such public utilities shall meet all other requirements of this Ordinance: Indianz Bell Telephone Co,any; Indian~ Gas Co., Inc~ Public Service of Indi~; and Carmel Water & Sewer Utilities.
