WHEREAS, it is necessary that the motor vehicles of the Fire and Police Departments of the Town of Carmel, as well as other emergency ~nd rescue vehicles have a free and unobstructed means of access to buildings in the Town which are used or occupied for multi-family, business or commercial purposes; and WHEREAS, in order to accomplish such purpose it is necessary to provide and maintain open areas of lanes, alleys, privately- owned public parking lots, driveways, and service areas which will at all times be available for use by such vehicles; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF CARMEL, COUNTY OF HAMILTON, STATE OF INDIANA: Section 1. (a) It shall be unlawful to cause or permit any vehicle or other obstacle to stand, park, or remai~ when not occupied by a licensed driver or in the process of loading and unloading merchandise, in any lane, alley, privately-owned public parking lot, driveway, or service area, within twelve (12) feet of any building, accessory structure or sidewalk which is immedi- ately adjacent to or attached to any building, where such building is occupied by more than two families or is occupied for commercial, professional, religious or other type of occupancy or assembly, in such a manner as to obstruct the free passage of the Fire Department vehicles, Police cars, emergency or rescue vehicles, or any other vehicle performing a public or emergency function, or in such a manner as to obstruct the free passage of any other vehicle through or over such restricted area. - 2 - 1.45 ) 540 1!R:iOlll _. _ PAGa' restricted area of twelve ,(12) feet shall be measured from the inaccessible areas abutting the lane, alley, prviately-owned public parking lot, driveway, or service area and a twelve (12) foot fire lane established so as to permit free and continuous passage of vehicles. (c) TheCa'rmel Fire and Police Departments shall inspect the area surrounding all buildings to which this section applies, and the Chiefs in charge of said Departments 'shall determine the . ' location of the emergency vehicle lanes established herein and they shall notify the property owners affected thereby in writing, and they shall report the same to the Town of Carmel Engineer, whose duty, it shall be to cause the erection or posting of a sign or signs which sh all read: "NO PARKING, FIRE LANE TOW AWAY ZONE"; the costs of signs shall be assessed against the property owner, and further a line shall be caused to be painted upon the surface adjacent to such buildings marking such lanes. (d) Any vehicle found parked or standing unattended in violation of this Ordinance may be removed at the order of a Police Officer with expense for such removal to be assessed against the owner of the vehicle. Section, 2. Any person who shall violate any of the provisions of this Ordinance shall, on conviction, be fined in any sum not less than Ten Dollars ($10.00) nor more than One Hundred Dollars ($100.00) and each day that such violation shall be permitted to exist shall constitute a separate offense. Said fine and Court costs shall be assessed in addition to 'any costs for the removal of said vehicle. Section 3. This Ordinance shall be in full force and effect ~OO~ from and after its passage, approval by the Board of Trustees, and publication as provided by law.
