HomeMy WebLinkAboutD-17 Bond to cut Public Way AN ORDINANCE REQUIRING A PERMIT AND BOND PRIOR TO CUTTING INTO ANY STREET, SIDEWALK, CURB OR PUBLIC PLACE IN THE TOWN OF CARMEL BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF CAR~ML: 1. That there shall be and there is hereby established the requirement for any person or firm pursuant to a private contract for the benefit and use of his abutting real estate in making any cuts into the pavement or in any other portion of any street, sidewalk, curb, or public place, and to excavate therein, or to excavate ben~ath the surface for the construction, alteration, or repair of any driveway, sewer, or sidewalk or for the installation of any such work, to have a special permit from the Superintendent of Streets of the Town of Carmel. 2. ~nat the person or firm doing such work under any special permit shall also agree to indemnify the Town, and also any party in interest under such contract, against all claims, demands, actions~ judgments, losses and expenses, arising from any injuries to any persons or damage to any property resulting from such work, or from any conditions so created in the street or public place. 3. Every applicant for a permit shall post a cash deposit of ~2o;v0 with the Clerk of the Town, which shall remain on file until the completion of the work, said cash bond shall be returned only after inspection by the Superintendent of Streets following 'the completion of the work with his approval that the public property disturbed has been replaced in a condition as good or better than prior to the work done. In the event the public property has not been restored in its condition as it existed prior to the work, the amount 4.
