AN ORDINANCE RELATING TO MAGAZINE SOLICITORS.
BE IT ORDAINED BY TH~ BOARD OF TRUSTEES OF THE TO~ OF CARMEL, INDIANA:
Section 1. It shall be unlawful for any person, partnership, or corpora-
tion either directly or indirectly, to conduct, operate, maintain, or manage
the business of magazine solicitation and magazine sales~ in whole or in part,
without a license or permit by the Town° No such person~ partnership, or corpora-
tion shall operate or permit the operation of such magazine business during any
time when his license or permit therefor has been suspended, revoked, or has
expired. Auy local non-profit organizations or groups, and veterans in accordance
with the state law, are specifically exempt from payment of fees under this
ordinance°
Section 2. The standards for the issuance or refusal of a license or
permit shall be considered and applied as may be applicable in each instance
as follows:
(a) Must be a citizen of the United States or a declarant therefor°
(b) Must not be member of party, group, or organization at time of
application for license or permit, which advocates any subversive
practices or fosters the overthrow, destruction, or sabotage the form
of government in the United States and such applicant must so qualify
by his oath at the time of his application.
(c) Must be of good moral character and any conviction of a felony,
unless pardoned therefor, and previous conduct in the solicitation and
selling of magazines may be considered in the issuance, or refusal, cf
any license or permit.
Section 3. The Clerk-Treasurer shall issue all licenses or permits in
the name of the Town and is authorized to adopt, prepare and approve all forms
and to prescribe all information required for applications, licenses, permits,
receipts, and all other papers relating thereto.

temporarily ,by order of any such official for a violation of this ordinance, until
the operations are in compliance with the ordinance. Any licensee or permitee, so
affected may appeal forthwith from such order to the Town Board for hearing on the
action of a s~nmary suspension temporarily or revocation of a license or permit.
Section 5. The sum of One Dollar ($1.00) shall accompany each application
or renewal for a license or permit, b~on approval and issuance of a license or
permit the sum of Five Dollars ($5.00) for each day, or any part thereof, for which
application is made, shall be paid by the holder thereof before he may engage in
magazine solicitation or selling. No license or permit shall be good for more
than one person. ~ne One Dollar ($1.00) application fee shall be retained by the
Town whether the application is approved or refused. Ail fees and all other charges
shall become a p~rt of the General Fund of the Town.
Section 6. Any person, partnership or corporation who shall violate any
provision of this ordinance shall be subject to an action by the Town and upon
conviction, or on a plea of guilty, shall be assessed a penalty in a sum not exceeding
~venty-Five Dollars ($25.00) and costs. Each day a violation continues shail con-
stitute a separate Offense and the Court may suspend all, or any part of such
judgment and costs.
Section 7. This ordinance shall take effect and be enforced from and after
Passed and approved by the Board of Trustees on the Jq~ day of
