ORDINANCE D-1756-05
AS AMENDED
AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL~ INDIANA~
CREATING AND ADOPTING CHAPTER 8~ ARTICLE 4~ SECTION 8-39
OF THE CARMEL CITY CODE
WHEREAS, the Common Council has established certain criteria for the approval, installation
and use of "speed.humps" withifi the City's corporate limits, which criteria have been codified in Carmel
City Code Section 8-38; and
WHEREAS, the Common Council has established City Code Section 8-39 as its listing of those
City locations whereat the installation and use of "speed humps" has been approved in accordance with
City Code Section 8-38; and
WHEREAS, the Common Council finds that the installation and use of "speed humps" in the City
on Emerson Road between York Drive and Sherman Drive, on Emerson Road between Lantern Drive and
Guilford Road, and on Sherman Drive between Emerson Road and Main (131st) Street, such locations
being more particularly described on the document attached hereto and incorporated herein as Exhibit A,
meets the criteria ~et forth in City Code Section 8-38, as established by the document attached hereto and
incorporated herein as Exhibit B, and that such installation and use should therefore be approved.
NOW, THEREFORE, BE qT ORDAINED, by the Common Council of the City of Carmel,
Indiana, as follows:
Section 1. The foregoing Recitals are incorporated herein by this reference.
Section 2. The construction and use of "speed humps" at the locations identified in the Recitals
meets the criteria set forth in City Code Section 8-38, and is approved.
Section 3. Chapter 8, Article 4, Section 8-39 of the Carmel City Code is thereby amended and
shall read as follows:
"Sec. 8-39. Authorized Speed Hump Locations.
The following City locations are authorized for the construction of "speed humPs" pursuant to
Section 8-38 above:

Medalist Parkway between 122nd Street and 126th Street.
Emerson Road between York Drive and Sherman Drive.
Emerson Road between Lantern Lane and Guilford Road.
Sherman Drive between Emerson Road and Main (1 31st) Street,

Section 3. All City ordinances or parts thereof inconsistent with any provision of this Ordinance
are hereby repealed, to the extent of such inconsistency only, as of the effective date of this Ordinance.
However, the repeal or amendment by this Ordinance of any other ordinance does not affect any rights or
liabilities accrued, penalties incurred or proceedings begun prior to the effective date of this Ordinance.
Those rights, liabilities and proceedings are continued and penalties shall be imposed and enforced under
such repealed or an~ended ordinance as if this Ordinance had not been adopted.
Section 4. Should any provision or portion of this Ordinanc'e be declared by a court of competent
jurisdiction to be invalid for any reason, the remaining provisions shall not be affected so long as they can,
without the invalid provision, be given the effect intended by the Common Council in adopting this
Ordinance; To this end, the provisions of this Ordinance are severable.
Section 5. This Ordinance shall become effective upon proper passage, signing by the Mayor and
such publication as is required by law.

Justification
Studies have indicated that speed humps are effective in reducing vehicle speeds to
25-30-mph. As indicated on the attached Warrant Analyses, the 85th percentile speed
for each case would need to be 23-24 mph to achieve the minimum number of points
when considering all other factors.
Considering that the lower speed of the range of effective speed reduction is higher than
the 85th percentile speed necessary to achieve the minimum number of points, it would
be reasonable to assume that traffic is currently or will be traveling at a sufficient speed
to warrant the installation of speed humps.
The Department Of Engineering recommends the installation of speed humps for the
road segments considered as the conditions meet the warrants of Carmel City Code
8-38.
