D-1763-05 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL~ INDIANA~ AMENDING CARMEL CITY CODE CHAPTER 8~ ARTICLE 3~ SECTION 8-22(a)~ CHANGING THE SPEED LIMIT TO 40 MILES PER HOUR ON CERTAIN CITY STREETS WHEREAS, the City 9f Carmel, Indianal has the authority to establish motor vehicle speed limits pursuant to Carmel City Code Chapter 8, Article 3, Section 8-15; and WHEREAS, the Common Council now finds it necessary to establish speed limits on certain City streets. NOW, THEREFORE, BE IT ORDAINED, by the Common Council of the City of Carmel, Indiana, as follows: Section 1. The foregoing Recitals are fully incorporated herein by this reference. Section 2. Pursuant to City Code Section 8-15, City Code Section 8-22(a) is hereby amended to include the following streets: "5) 131 st Street from Towne Road to Clay Center Road 6) TowneRoad from 116th Streetto 136th Street 7) Ditch Road from 131st Street to 146th Street 8) 141st Street from Towne Road to Springmill Road 9) 116th Street from Shelbome Road to Towne Road 10) Springmill Road from 116th Street to 146th Street 11) 136th Street from Towne Road to Oak Ridge Road 12) Reserved." Section 3. The Carmel Street Department is directed to promptly install appropriate signage consistent with this request. Section 4. All other current provisions of City Code Sections 8-22 shall remain in full force and effect and are not affected by this Ordinance. Section 5. All prior ordinances or parts thereof inconsistent with any provision of this Ordinance are hereby repealed, to the extent of such inconsistency only, as of the effective date of this Ordinance. However, the repeal or amendment by this Ordinance of any other ordinance does not affect any rights or liabilities accrued, penalties incurred or proceedings begun prior to the effective date of this Ordinance. Those rights, liabilities and proceedings are continued and penalties shall be imposed and enforced under such repealed or amended ordinance as if this Ordinance had not been adopted. Section 6. If any portion of this Ordinance is for any reason declared to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portions of this Ordinance so long as enforcement of same can be given the same effect.
