D-1765-05 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL~ INDIANA~ ADDING SECTION 8-24 TO CARMEL CITY CODE SECTION 8~ ARTICLE 3~ ESTABLISHING FORTY-FIVE MILE PER HOUR SPEED LIMIT ON CERTAIN CITY STREETS WHEREAS, the City of Carmel/Indiana, has the authority to establish motor vehicle speed limits pursuant to Carmel City Code Chapter 8, Article 3, Section 8-15; and WHEREAS, the Common Council now finds it necessary to establish speed limits on certain City streets. NOW, THEREFORE, BE IT ORDAINED, by the Common Council of the City of Carmel, Indiana, as follows: Section 1. The foregoing Recitals are fully incorporated heroin by this reference. Section 2. That Chapter 8, Article 3, of the Carmel City Code is hereby amended to add a new Section 8-24 which shall read as follows: "Sect. 8-24, Forty-five m.p.h. Speed Limit Designation: (a) No person shall drive a motor vehicle in excess of 45 miles per hour on the following streets: 1) 2) 3) 4) 5) 8) Grey Road from 96th Street to 106th Street Shelborne Road from 116th Street to 146th Street Towne Road from 136th Street to 146t~ Street 141 st Street from Boone County Line to Towne Road 131st Street from Boone County Line to Towne Road Reserved" Section 3. The Carmel Street Department shall post appropriate signs and markings on the above described public streets clearly indicating thereon the altered speed limits. Section 4. That the remaining provisions of Cannel City Code Chapter 8, Article 3, are not affected by this Ordinance and remain in full fume and effect. Sections 8-25 through 8-27 are reserved for future use. Section 5. All prior ordinances or parts thereof inconsistent with any provision of this Ordinance are hereby repealed, to the extent of such inconsistency only, as of the effective date of this Ordinance. However, the repeal or amendment by this Ordinance of any other ordinance does not affect any rights or liabilities accrued, penalties incurred or proceedings begun prior to the effective date of this Ordinance. Those rights, liabilities and proceedings are continued and penalties shall be imposed and enforced under such repealed or amended ordinance as if this Ordinance had not been adopted. If any portion of this Ordinance is for any reason declared to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portions of this Ordinance so long as enforcement of same can be given the same effect. Section 7. This Ordinance shall be in full force and effect from and after its passage and signing by the Mayor.
